Unfair Claim Settlement

On 12/15/11 a driver, insured by Access General, hit my 1996 Chevy Surburban and totaled it out. I filed Claim Number ACI0195108 on 12/30/11 because the at fault driver refused to give me her driver license and insurance information. I had to wait two weeks and pay $12.00 for the police report. Today, over six months after the accident, I still do not have a replacement vehicle. In 2004 I paid $9,000 for my vehicle. It was fully loaded, all electric, and had many extras. Just three months before the accident I invested $936.55 in the front and rear air conditioning system on the vehicle. In addition to being fully loaded the vehicle had an extra gas tank, a tow package, a Sony stereo system, a keyless alarm system, running boards, a luggage rack, all tinted windows. On 01/18/12, without even talking to an adjuster or accepting an offer, I received a check, from Access General, in the amount of $2,489.93. The Kelly Blue Book Value, for my vehicle without the extras is $4,000. They do not accept Kelly Blue Book as a value source. They refuse to give me credit for all the extras on my vehicle and they refuse to give me credit for the repairs made to the air conditioning system in my vehicle. They will not give me credit for the days I missed work to deal with the claim. They will not give me credit for the time it takes to located a comparable vehicle. They will not give me credit for sales taxes and registration fees I will have to pay to register a vehicle in my name. And, they insist on handling the claim out of their Georgia office even though they do have an office in California. The three hour time difference makes it impossible for you to communicate with them.

Either buy me a vehicle just like the one their insured wreaked. Or, pay me the amount I need to purchase a vehicle just like the one their insured wreaked. Plus the sales tax and registration fees I will have to pay. They need to leave me in the position I was in before the accident caused by their insured.

I don't know if you've ever dealt with an insurance issue before but
auto insurance does not cover repairs and upgrades you've made or any
kind of sales tax and registration fees. Those are considered the
cost of owning a car.

You paid $9000 for it in 2004 and have owned the vehicle for over 7
years. You cannot expect to get anything close to $9000 for it no
matter what extras you have. If you want full replacement cost you
have to include it in your insurance policy and pay (dearly) for it.

Why are you not handling this through your insurance? I'm guessing
you don't have comprehensive. If you want a better settlement you
should have kept comprehensive on your car and dealt with your
insurance company.

I must have missed yopur mention of what your insurance company, as
your rep, is doing to help you in this effort.

I hope you are able to get a fair settlement for you wrecked vehicle.
However, I do not know of any insurance company that will pay you for
non-factory installed extras that were on/in the vehicle or for taxes
and registration costs.

Without knowing the mileage and condition of your truck before the
accident, I cannot comment on the amount of the settlement. Most
insurance companies will pay the lowest book value possible for a
settlement, especially the cut rate companies.

I had a car that was hit in a parking lot several years ago. I was
lucky enough to witness it and stop the woman from driving away. Her
insurance company didn't want to pay the full amount it would cost to
repair my car. The body shop and my insurance company fought her
insurance company and were able to collect from them.
