Bad Experience at Applebee's

Some friends and I stopped into Applebees in New York (at Times's Square) for a couple cocktails on October 13th, 2007, around 10:15pm. At the bar (after staring at the bartenders who were standing around talking to each other and ignoring us for 5 minutes), we tried to order something with Red Bull (we saw another customer at the bar with a can) and were told there was no Red Bull, and no other kind of energy drink. Odd. We noticed another member of the waitstaff drinking what appeared to be an energy drink out of a can, but didn't press the issue because the bartender was already rude.
We ordered 2 rum & cokes, and a diet coke.
When we got the bill, it was over $25.00. We saw that the entire bill was taxed (normally alcohol is not taxed) and that there was 17% gratuity automatically added to the bill.
When we sought management's explanation, we were told that anytime a "food item" is added to a bill, the entire bill was taxed. 1) That cannot be true and 2) Since when is a Diet Coke a "food item" when you can't eat it, and it's ordered at the bar with other alcoholic beverages?
Also, the fact that 17% gratuity is automatically added to bills after 10pm is absurd. There is no mention of it anywhere in the restaurant, except for a small (maybe 1 foot by 1 foot) sign near the kitchen, about 3 feet off the floor. It's not posted at the bar, stairs, or seating areas.
I don't want a free meal or a coupon to Applebees as I will probably never step foot in one again. But I want corporate to be aware of the incident and to change the "policies" for future customers. It's just not right.

I am going to have to go and agree with some of the others and disagree with your complaint.
1.) You noticed the sighn
2.) In certain places all though not very common
the alchohol is taxed with the bill instead of
the knwon price
3.) Sounds like it was your first time there, I would
have asked for the prices before ordering, in
certian restaurant chains they charge an arm and
a leg for regular drinks like those as opposed to
their own specials like random fruity drink number

Be happy you don't live in Ontario. Here alcohol is charged at 10% sales tax and food is charged at 8%. If you order a meal and wine you are paying that much more for it. It's not just certain restaurant chains that do it, here it is all. It is the law.
Think about that next time you compalin.

As far as tax goes, anytime a sale takes place the establishment is required to to collect tax (which they are then required to forward come tax time to uncle sam) So that covers your food item comment.
As for your gratuity, as a server I was a little disshartened to learn that you DONT have to pay gratuity. And ive never heard of an establishment placing gratuity on a check just because you came in after a certain time.... sounds kinda shady. Happy hour and its half priced drinks or appetizers are to attract business.... to what basically ammounts to charging a guest additionally for coming in after a certain time just doesnt sound right and I would call corporate and take that up with them.... Quite sure they would not be happy to hear that this is going on.
Serves you right though for going to Applebee's. Doesnt your town have anything better open at 10pm?

You never have to pay gratuity. They may add it but you are not required to pay it.
As far as the tax goes... most places will add the tax right into the price but not all do and retail alcohol is very much taxable in many many places.

uhhhh you moron alcohol is taxed in N.Y and the red bull was probably that the bar tender brought it from a gas station or his own house....so use your head you retard...also they probably didn't ignore you but at a bar you look at what you want then you call them over...applebees isn't exactly a 5 star restaurant so quit whining
so many whiners on this website...wow people just get on with your life who cares about your experience

This experience sounds odd. The gratuity I would have fought - they shouldn't do that. The attitude I don't understand, brfore you even got your drinks. The taxation part doesn't sound right. If an item is taxable, then it should be taxed. If not, then it isn't taxed. How the heck does adding a taxable item to a bill cause other non-taxable items to be taxed? Someone else pointed out alchohol is already taxed in the price.
I would take my business elsewhere. In my area there are three A-Bee's. Each has its own character; they are not all equally enjoyable to visit.

The manager was wrong. The tax is already figured into the price of the alcohol (hence the nice round numbers when you're sitting at the bar ordering beers/cocktails). So to tax you on it AGAIN was illegal.
I agree that a small sign by the kitchen entrance is meaningless. You know you don't have to pay those "automatic" gratuities, right? There's nothing mandatory about them. I don't blame you for not wanting to go to THAT Applebee's again, but I've been to Applebee's later in the evening and never had the problems you encountered; it's not that it's Applebee's--it's just one bad manager running a bad place.

Applebees did nothing wrong. As long as there is a sign posted somewhere in the store that is visible to customers (and it must have been because you did see it) then they can do whatever it said,legally.

I think maybe you should learn what can be taxed again, because alcohol, and beverages can both be taxed. Applebees did nothing wrong
