On Monday, April 6th 2009 an erroneous debit hit my checking account. The company I make my car payment to took out an extra payment. I have been in the process of ending my relationship with them, but that is a different matter.

The charge hit my account after close of business on Monday. This overdrew my account by a few dollars. There were several small debits that posted at the same time, and a check.

I was charged a $35 fee for each debit that hit my account that night. Tuesday morning, before the bank opened, I checked my account and became aware of this. I took cash to an ATM and deposited into one of those new ATMs that counts your cash and credits it immediately to your account.

Later on Tuesday, I found a slew of "Overdraft Fees". I called customer service, and was told I couldn't do anything about those fees until they "posted" as they were only "pending." The next morning, the charges had posted so I called again.

I explained that, while I do believe a fee might be appropriate, charging me 5 fees at $35 each was ludicrous. I was told that it was the policy of the bank, and that it was an automated system, and there was nothing that could be done about the $175 in fees they took out of my account.

I have been a Bank of America customer for a long time. In these economic times, it is difficult to keep everything afloat for someone like me. Never did I anticipate my bank, of many years, to do this to me. I am going into a branch tomorrow to discuss this in person, and to possibly close my account. I can't afford to do business with a company that would do this to a customer.

If Bank of America would like to keep me as a customer, I suggest they contact me within the next few days and offer to remove the fees.

Thanks for all the support, you guys. I appreciate it. To clear up a
few things, I am working with the company that was debiting my account
for the car payments. Everything was fine for 18 months, then
problems. They have been a pain to work with, but hopefully that is
over. I can't get them to stop debiting my account incorrectly, so
once that is figured out, I will go after the fees.

Yep, the sticker says the 8 PM thing, Nate. And I did deposit the
money the next day, not the same business day as the charges.

Not sure what you mean, MA Cunningham, about a single branch making
the money from my account fees. Also, I opened my account in Florida,
and now live in Oregon, so I can't go to the branch I opened the
account at but I am going to my local branch tomorrow.

And to Rowdy... While I appreciate your participation in my shared
letter, pointing out what you believe to be the faults of others isn't
in good taste. I'm sure I heard something about casting stones in that
good book of yours. And I know, I am practically begging you to come
back and comment about how you have some awesome financial life with
no debt and how, as the rest of the scripture says, you are the
wealthy who rule the poor, but I'm not sure what your elitist attitude
will bring to the discussion.

The Image-Deposit ATM credits it if the deposit is made before 8pm on
a business day. That's what the sticker says on all of them in my
area.

If you speak with the branch manager and explain the situation and how
it was an error on a third party who regularly debits your account,
they will most likely forgive it.

It costs more money to get a new customer than retain an existing one,
so if you have no history of overdraft fees, I bet they will let you
off this time. But remember to pay close attention as they will not be
as friendly in the future.

I think your car payment company owes you all of this money, not
necessarily the bank. I hope *someone* comes through for you. This
isn't right OR fair!

they can't help you and since losing your business does not affect
their bottom line, they do not care.

Whenever there are NSF fees or fees for anything, you need to go back
to the branch you opened up the account at and speak with that
manager. Since their location profits from those fees, it is at their
discretion whether they will refund them or not.

It really sounds to me like your beef is with the company that took
out the extra car payment.

All of this stems from the fact that you signed up for debt, your car
payment. Had you bought a car that you could afford to pay cash for,
you would not be in this situation.

As the good book says, the borrower is slave to the lender.
