I have a check that was issused by Bank of America and at the time I recieved the check I put it up. I had forgotten where I put the check and so it was pass the 120 days when I found it. I can not cash it and need to have a check reissued to replace it. and have had no luck in doing this just the run around. But tonight I found the phone number for the CEO of Bank of America and I hope I can get some results.

All I want is the checked reisssued so I can cash it, that is all. Please Mr Lewis can you do something about this I have called the phone number and all I get is a answering machine that says to send a email whem I did this it said that I would hear form them in 5 to 10 days and it has been past that.I gave them all the information in the email but get now results for now I am asking for help from the CEO of Bank of America. Thank you

The fact is, it isn't the bank's money, it's the OP's. There most
definitely should be a procedure in place to handle a situation like
this. Tellers and other bank employees have three-ring binders full
of procedures and how to do things. This process should be included.

It isn't rocket science. The OP shouldn't have to work this hard to
get HER money back, even though she is the one who misplaced the
check.

I support that notion for INDIVIDUALS, but not for businesses by RedheadwGlasses Sun July 26, 2009 @ 11:02 PM

I had an outstanding check for 18mos once. My aunt forgot I gave it to
her for her birthday and she put it away with the cards and forgot
about it until she was cleaning the drawer and found it. She called me
and asked if she could cash it, I still had the funds in the account
so I told her to go ahead...they cashed it without a problem.

If this is monies owed to you by BOA then its still showing on their
account as being outstanding. So while I agree you should have kept
the check in a more important place so you could remember to cash it,
they should issue another check if you give them the past dated check.

That is why they give you almost 6 months to cash the check.

It is not their fault you didn't cash it in time, nor their fault you
forgot where you put it.

Yet you are holding *them* responsible for it.

edit - 4 months instead of 6, still that's a *third* of a year n/t by PepperElf Sat July 25, 2009 @ 10:07 AM

you cant expect them to be on the hook forever, 120 days is a
reasonable amount of time, my paychecks are only good for 90 days. you
said you "put up" the check, why not cash it as soon as you receive it
so you wont have to keep track of it?

good luck, but they are not obligated to issue you another check. You
had 4 months.

I have a check I wrote on my BOA account May 9 that hasn't been cashed
yet. I asked how long until it is considered no good and I was told
"never". I clarified - "So if someone wants to cash it a year from
now you will honor that" and I was told yes.

No I'm wondering which is true. Surely it can't be forever, can it?

They gave you 120 days. It would be nice if they did, but they could
easily not re-issue it as they gave you sufficient time and what
happened was your fault.

You need to contact the person or company who issued you the check and
ask them to reissue you the check. It may take a few business days, as
they will have to verify that your check was never cashed.

Can't you just take the check to a local BoA branch and speak with
someone there? You know Ken Lewis isn't going to help you.
