Unauthorized Debit Card charge

Below is copy of a complaint sent via the Blockbuster Video customer service link on their website:

Hello!

I am writing to express concern over an issue. On 1/13/06, while checking my online bank statement, I noticed there was a $25.86 charge from a Blockbuster Video location in Sumter, SC. Knowing I haven't rented any videos for some time now, especially from my hometown of Sumter, I immediately called the only two Blockbusters in Sumter. The one located on Guignard Dr. and on Broad St.

As it turns out, my younger sister had used my card to rent some movies ("The Gingerbread Man" and "Cursed") from the Broad St. store and **perhaps** failed to return them. The kind gentleman I spoke with on the phone offered to place an alert on my account in the event my sister attempted to use my card again in the future without my knowledge or permission.

I, of course, confronted my sister about this. She immediately contacted the store and advised them that she had returned the movies 3-4 days before the due date. My sister explained to me that the person she spoke with at the store advised her that he'd located one of the missing movies "The Gingerbread Man" but not the other "Cursed." He stated to her that he would refund my card $15 but would not be able to refund the remaining amount because he is unable to locate "Cursed."

My sister swears that she returned both movies (and I'm inclined to believe her, especially after one of the movies has been found). My sister also mentioned that she has been able to rent other movies from this location even after "failing" to the return the movies that were supposedly missing.

I'm contacting you because I'm concerned about the store having possibly lost the movie "Cursed" and holding me responsible for its charges even after my sister says she returned both movies, they originally thought two movies were missing but after looking were able to find one, and my sister was able to rent additional movies after returning the movie that is claimed to be missing.

I am especially concerned that my debit card was charged without my permission (signed or otherwise) or knowledge. I am upset that you would even have my debit card number on file to charge it without my permission. I do not have any services with you that requires a monthly recurring charge, so there is no reason for my card # to be on file. If the entire amount is not removed from my bank account, it is very likely that I will dispute this amount with my bank and I would imagine you'd have a hard time justifying the charge without anything showing my written consent for the charge in the first place. I will also be posting this information on Planetfeedback.com, just so that other customers know what they are up against, in the event this or something similar happens to them.

I would like for Blockbuster to refund the entire $25.89 that they charged to my debit card.

I also want them to remove my debit card information from their system.

They need to take the necessary actions (such as contacting me by phone or in writing) before charging my account.

I can't speak on the issue of the non-returned movie (although after 8
years in the business with both Hollywood and Blockbuster I can tell
you that it is about 1000 times more likely for a customer to think
they returned a movie than for the store to continually make a mistake
through checking the dropbox (it's a square box folks), doing checks
on the shelf, and doing inventory). However I will state that there
is absolutely positively no way for a Blockbuster to gain access to
your credit or debit card unless you gave it to them to open the
account, update the account, or rent more than one or two games on
your account (depending on the store game policy). Blockbuster has no
power to go random banks and get credit or debit card numbers for
customers. You gave them the card. Period.

I just checked my online bank statement. Blockbuster has refunded me
$15.39 of the $25.89 they charged me. I will probably continue to
dispute in order to receive the remaining $10.50.

When you signed up for your account you used your card number as a
secondary form of ID to secure the account. The contract does state
that you are authorizing Blockbuster to charge your card for things
like unreturned items.

You can have the card number removed from your account by providing
one of the other secondary forms of ID that Blockbuster accepts while
you are in your local store.

Your best bet is to speak with the Store Manager and if you get no
satisfaction there then move up to the District Leader, then to the
Regional Manager. Blockbuster's corporate offices do not deal with
customer issues so your best bet is to move back into store/district
level management.

Ever READ a CONTRACT before you sign it? You gave them your credit
card# and auth. them to do just this. Read your CONTRACT!
