Unorganized and deceptive customer service rep at Capital One

I had moved to a new address and I never received a bill for my Capital One Credit Card statement causing my account to be past due and transferred to the collections department. After being notified by Capital One Credit Card, I initially attempted to dispute the charges with no success. Also, I was paying for the credit protector monthly service fee. Therefore I decided to negotiate the total amount due with a customer service rep in the collections department. In return for payment, Capital One Credit Card would remove all negative items related to this account from all three credit bureaus. She confirmed that she would send this in writing. Therefore, I went ahead and paid off the full amount. I have not received a written confirmation that after final payment all negative items would be removed from my credit reports AND the negative history is still showing up on my credit reports.

As promised with the customer service rep I talked with, I would like written confirmation that all negative records be removed from my credit report which was promised via customer service rep on the phone and I request that Capital One remove all negative items on my credit history as promised. I have fulfilled my end of all obligations while Capital One Credit has not.

They cannot and will not remove credit reports that were accurate.
You were delinquent, no question about that, and they correctly
reported it. What I would imagine that they agreed to is to not
report you as a charge-off on the amount you negotiated. You should
count yourself lucky that they are even willing to do this.

"I have fulfilled my end of all obligations", Not hardly!

Sorry but you could have also gone online to pay your bill or called
it in. So you cannot use not recieving a hard copay as an excuse.

As for the written confirmation...all you need is a bill that shows
paid in full...forward a copy to the credit bureau(s).

Did you think that because you moved and did not get a bill you did
not owe Capital One? You certainly knew that you had a due amount
with Capital One. It is your responsibility to pay your bill. Just
because your bill did not catch up with you before it was overdue does
not mean you get a "ride".

I am always amazed when people blame a company for not paying their
bill. You know when it is due and how much it is. If you don't, you
need to learn organizational skills.

Had you notified Capital One of your new address and they failed to
make the change, or did you not contact them? If you let them know you
were moving and they didn't follow through with an address change, you
may have a case. Otherwise your own negligence is at fault.

Michael Y.,

This interests me.

I've always understood that once it went to Collections and was
finally paid off all the reporting company had to do was assure that
the item was marked paid as opposed to removing the item from your
credit report.
