Capital One Redated My Accounts

I had 2 accounts with Capital One, one opened in 2002 and the other opened 2000, I was never late and always paid on time until I was diagnosed with cancer in July of 2002.

I called and asked if I could use the insurnace that I paid every month for if I was unemployed, they told me since I was going to be out of work for a long time due to chemo that I would not qualify to make any claims.

At that time I asked if there was anything I could do to pay what I owed at the time it was only 2-500 between the 2 accounts and that I would like to close them after I paid them in full.

I was told NO there was nothing they could do to help me in my situation, so I made the last payment that I could afford in July 2002 and let it go into default, my hands were tied. All I was asking for was to stop the over the limit fees and late payment fees and cut the interest in half so I could fulfill my obligation to you and pay the accounts off instead of going into default. What started out as 2-500.00 has now grown into over 4000.00. I didn't ask to get cancer, I didn't ask to lose my job, I didn't ask to lose my hair, vomit everyday all day long, I didn't ask to lose 150 lbs making me look I was a walking skeleton.
ANd I surely didn't ask to be punished by Capital One for something that was beyond my control.

I left these accounts alone for 6 1/2 years. For 6 1/2 years Capital One has been updating on my reports with a Date of First Delinquency of September 2002 on Equifax and Trans Union and Jan 2003 on Experian and a CO comment to make it look like the account was Charged off EVERY MONTH.

I disputed them with all the credit reporting agencies in Feb 2008, the information on my reports were verifed and UNCHANGED. The DOFD was still reproted as 9/2002

I disputed them again in June of 2009, after all 7 years from what was reported meant that the accounts can only report for 7 years after the DOFD meaning that they could not be reported after Aug and Sept of 2009.

With this dispute in June 2009, Capital One verifed once again both accounts but changed the information that will make it report 7 months longer then they should, now the accouns will report until Jan, Feb and March of 2010!

I have past credit reports dating back for years proving these dates were reported.

Ladies and Gentlemen, what capital one has done here is ILLEGAL, you CANNOT re age an account to report longer then it should.


Capital One has caused me to suffer credit deinals for a new home as well as a new car and other financing.

I have suffered almost 7 years because of these Capital one, I tried to work an agreement with them before it got to this point but they refused, I am not going to suffer anymore.

I want them DELETED from my credit reports and to NEVER be reinserted again.

DO NOT ask me to call your customer service department to work something out, it is past that, I tried that over 6 years ago and NO ONE wanted to help me then, why start now.

To date, I have filed complaints with the VABFI they forwarded it to
the OCC, the FTC, My AG which was forwarded to the OCC, the VA BBB as
well as the UT BBB and for good measure I filed a complaint with eh
OCC personally. I think I have pretty much covered all the bases for
complaints and just about hit them from all sides.

I recieved a response from the OCC stating that they looked at
everything I sent and agree that there are several violations and
contacted Cap One, I am still waiting on those results.
