Cheated by Circuit City's False Advertisement

On February 9th, 2009 I went into Circuit City, York, PA and purchased two games for my Nintendo DS, Littlest Pet Shop: Jungle and Viva Pinata Pocket Paradise. The games were 30% off due to their going our of business, which was a great deal. Once I got the games home and opened them up I found out they were USED games. The registration card was missing out of one and the registration card and play book was missing out of the other one. No where in the store or on the games did they say they were used games or returned games. Honestly I wouldn't have bought them had I known they were not a complete game.
I understand that Circuit City is going out of business and needs to liquidate their stock but they do NOT have to cheat longtime customers who have been buying from them for years. This is not the way to do business or go out of business, it is cheating to get their last bit of money out of us. As they are going out of business this doesn't make me want to do business with Wells Fargo who is the one taking over their financial aspect of this deal, who must condone this as they are letting it happen as well.
What can they do to make it up to me since they are going out of business? I would like my games replaced with brand new unopened games so that I can register my games as I've done with all my games on the Nintendo site. If they can't do that then I would like my money back ($37.08 total purchase) since I paid for something that was not in ANY way advertised.

I went to this exact same Circuit City and I also purchased video games. There were pre-owned ones that were marked with a half-dollar sized sticker stating pre-owned. Although, they are shrink-wrapped just like a new game. I would check and see if it had that sticker. The used games were 10% more off than the new games. You might check and see if you got the correct price. It was a good deal, but that is the risk you take when purchasing from a liquidation sale. Chalk it up to a lesson learned, sometimes a deal isn't really a deal. Unfortunately, since they are going out of business, they clearly don't care as long as they got your money. It was funny because tonight as we walked out of the store, the security at the front of the store was playing a Nintendo DS. My husband joked that he stole everything in the bag. The guy said "ok, have a good night", never once looking up from his game. lol

It's my understanding that all sales are final. There's really nothing that you can do about this. Sorry!

Circuit City can't do anything for you, and they won't do anything for you, because they are in liquidation.
As such, the liquidation company is running the show.
To give you an example of how liquidation companies operate, here's an example from the book "Pretending You Care" by Norm Feuti, a cartoonist who went through a liquidation:
The liquidation company guy gave Norm and his fellow employees a phone number to give to customers who complained about not being able to return anything, and told them "If anyone gives you crap, just have them call me at this number. It goes to a dummy voice mail that I just delete every day. I don't even listen to it. (Bleep) them, they can read the signs."

you can register your Littlest Pet Shop: Jungle with Electronic Arts @ www.ea.com it has a register game link on the left side.the game Viva Pinata Pocket Paradise is by THQ and can be registered at there site www.thq.com with a register my game link on the left side of the screen

That is just how it is. There IS no Circuit City anymore, so I doubt anyone will get this message.
It does serve as a warning for others to check anything very carefully, because all sales are FINAL.
In rereading your letter, I see that it is documentation that is missing. If the games work, just enjoy them. I haven't registered a piece of software in years (unless it was necessary).
Don't blame Wells Fargo. Blame the last CSR's from Circuit City, before they lost their jobs and left the building, for leaving such a thing on the shelf. All the liquidators do is come in and sell whatever they see. They aren't going to open the boxes beyond what you saw when you bought it. If you didn't notice it, there is no way they would.

Although I think the other posters are right in that Circuit City probably won't do anything to make amends, it's a good thing that you posted on here to warn people. As someone else mentioned, if you buy anything from them right now have them open it at the register. I was watching the news the other night and a lady had called in complaining that she had spent $250 for a camera from Circuit City and when she came home and opened the package it was filled with garbage. Of course they will not refund her money and she has no recourse. So anyone thinking of taking advantage of the sale needs to be very careful.

Maybe they WEREN'T used. Maybe Nintendo just forgot to put the stuff int eh case. It happens. Try contacting Nintendo and see if they will send you new stuff.
I don't register my games at all. I don't see the point.
I didn't think CC sold used games.

Unfortunately I don't think their gonna do anything for you. Circuit City as you know it is gone. The liquidators don't care and certainly won't do anything for you.
A tip for everyone: check the merchandise before you buy it. If it's sealed, then have them open it at the register BEFORE you buy it.

Circuit City is no longer calling the shots and has no money to refund anyone for anything. Everything is now in the hands of the liquidators, and I don't think they are particularly friendly folks.
