No iPod for My Son's Birthday at Circuit City

It's my son's birthday September 1st, he will be fourteen. He wanted an Apples Video ipod. We found one at Circuit City.com. We ordered the video ipod and we were told we had 14 days to pick it up at the store.

Two days later, as my wife was making my son's birthday breakfast, I headed off the my local Circuit City Store #00891. I went to customer pick up and gave the girl my receipt, then I waited, and waited. She checked in back three of four times. She then checked with her manager. She came back to me and said we are all out. I said how is that possible. I have a receipt from your web site. All I need to do is pick it up. She said the web site was "another company". What!??!?! She also said it was never pulled from inventory. This is fraud!! Everything you sent me said it would be there when I came in to pick it up. I showed the girl and her manager the paper work. It said the item would be there waiting for me.

Well long story short, they didn't have it. None of your other stores in my area had it. We had one at Best Buy, but we ordered with Circuit City one instead. When we found you didn't hold the item, as you said you would, Best Buy was then sold out too. The Comp USA in Tampa said they had one, but after I drove all the way over there it turned out the sales girl was mistaken. There was no way to get the item to my son on his birthday.


The answer is this. I understand the reason your out is because apple is upgrading their Video ipods. I want the upgraded version sent to me at no costs as soon as it comes out. I think it's the least you can do given the circumstances.

When I first started reading this, I thought you had a valid complaint
- especially if you had prepaid for this item (not completely clear on
that one). Then I got to the last paragraph. If you prepaid, then you
would deserve a refund but to expect an "upgraded version sent to me
at no costs as soon as it comes out?" That just makes you sound
greedy.

Who waits until their child is literally eating their birthday
breakfast to go pick-up their gift - - a gift, I might add, that is
sold out almost everywhere?

I agree with the previous poster - - this whole thing sounds a bit
like you're using your son't birthday as a pity card to try and get
more than you are entitled to. Nowhere in your post does it say that
you have already paid for the iPod so that tells me that you request
for "the upgraded version sent to me at no costs" is a request for a
total freebie.

Why not just give your son an IOU for the iPod and let this serve as a
lesson for yourself to plan ahead a little better in the future?

Your lack of planning does not entitle you to get the item for free or
even for a discount.

Maybe it was the demand for the upgraded iPod at the end of the
letter, maybe it was the fact that he didn't order directly from iPod
and had it shipped to his son. The fact that EVERYONE seems to be
sold out of the old model so close to the new model being released.
Or maybe it was waiting till the DAY OF his son's birthday to go get
it and then wasting all sorts of time and energy running around to
find a replacement.

If you had time to get the unit, why did you pay for it but not go get
it for 3 days? I just don't understand all this, but I get this
nagging feeling you're trying to use your son's "ruined" birthday to
jip CC into coughing up a better model than you were entitled to.

Just curious, but did you pre-pay for this item, or were they just
holding it for you? You said that you had a receipt. If you did pay
for it, then I think you have a valid complaint. If they were only
holding the item for you, then I have to agree that it sucks that they
didn't pull it for you, but mistakes happen. I have used Best Buy's
online site, and I had to pay for the item first, and then had however
many days to pick it up. I would be really angry too if I had paid
for it and it wasn't there. Did they offer to have one sent from
another location? I don't know why you would think you would get the
upgraded ipod for free, though. That seems totally unreasonable.

If you love your son then you will get him an Archos or Cowon audio
player, far more superior to the iPod.

Next time, don't wait until 3 days before you need something to try
and get it.

Sorry, buddy...I really don't think you're going to get a free iPod.
Why didn't you just go to Apple's website and order one? That's what
I did, and they personalize the iPod for free!

I wouldn't wait by the mailbox for the free Ipod you expect them to
send you.

Maybe don't wait until the day of his birthday next time. I realize
you probably have never made a mistake before, but in the real world,
it happens.

Like that is going to happen, you get what you pay for nothing more.
I have a feeling this letter was writen mainly to a better ipod then
you paid for.

I'm sure you do want the upgraded version sent to you at no cost. I'd
like that for myself as well. But the inconvenience that you suffered
does not entitle you to anything free of charge. I'm sure that your
son will understand since he's 14 years old. My 9 year old would
understand & my 13 year old definitely would. I know he will be
disappointed, but things happen.

I haven't heard anything of Apple upgrading the video iPods. You paid
for the "original" one.. you get the original one. Usually when it has
the pick up option online, its for the same day, not up to 2 weeks.
Also, on their website, I see a 24/24 guarantee (ready in 24 minutes
to pick up or you get a $24 gift card) ... unless you have to be at
the very end of ordering to see the "you have 2 weeks to pick it
up"... which I think would be stupid on their end.
