My family are DirecTV subscribers. We have two boxes in our home and the only major problem we ever have with the service is during heavy rain, but that is understandable considering the technology involved. About a year or so ago, my father - the billpayer - asked me to inquire about having one of the remotes replaces because most of the text on it has worm off from use. I called the DirecTV offices the next day and was informed we'd have to pay to replace it. I refused, because the DirecTV employee had informed me during the call that the subscriber does not own the equipment and the fees are for the rental thereof and the monthly use of the service. We're already paying to rent it, and we don't own it. It doesn't make sense for the subscriber to have to pay to replace something that is not their property. It's not like we purposefully destroyed anything. It just isn't readable.

My dispute is based on your own policy. If the company still owns the equipment, why does the user have to pay to replace it? It's not ours, therefore we're not responsible for it - DirecTV is! You own it! We subscribed, we rent the equipment, and it's your property. So, again, we refuse to pay for anything that is not our property. There is nothing anywhere that I can locate that says the user must pay for replacements. I never had to pay for a data card for the box, and we have replaced those before! The equipment is your property, so I cannot see why you cannot be responsible and fix it so the customer gets what they've paid for - the service we subscribe to and equipment you rented to us.

Send us a new remote as we requested - free of charge, or we will consider either purchasing one elsewhere and billing DirecTV for it, or taking our business elsewhere.

Unless you subscribed to the protection plan, you are going to have to
pay for that new remote. There's no two ways about it.

And what about your contract with DirecTV? Are you willing to pay the
fees for that? It's not cheap.

As someone else mentioned, you are responsible for the
equipment...unless you have the protection plan. Then it is covered
under that.

WAit wait wait... this letter is over a REMOTE??? The text on remotes
wear off. Its called wear and tear. Stop being so cheap and buy a new
one!

We have Dish Network. We have had it for YEARS with NO problem. We
have had to replace our remote once. It just stopped working. It had
been dropped on to floor, a lot, lost in the couch cushions and stuff
like that. I called Dish and was told it would be $15 for a new
remote.(that included Shipping charges) I said "Ok" and had a new
remote in a few days. I gave the broken on to my toddler. (HE thinks
HE is changing the channels) Pay for the remote.

Also, I read that this happened a YEAR ago? What have you been doing
since then?

Oh, we have never had to replace the Data card.

Who wore the text off? You did. If you want a new remote, you will
have to pay to get it.

It's pretty much common sense, but then again so is free speech.

Not having DirecTV, I wasn't able to check my own agreement. However,
these folks do post their agreement on their web site.

Among other things, I found this:

"CARE OF EQUIPMENT. You are responsible for the loss of or any damage
to the DIRECTV equipment that you have leased from DIRECTV...DIRECTV
PROVIDES YOU THE DIRECTV EQUIPMENT AS IS...In the event the DIRECTV
equipment you have leased from DIRECTV does not operate, contact
DIRECTV at 1-800-531-5000."

How much usage did a remote control get in order for the
numbers/letters to get rubbed off? I'd say you've used it enough to
have to replace it yourself.

You're not paying for a new remote. You're paying because the remote
you already have is now unfit for use (according to you).

It doesn't matter whether you purposefully destroyed anything. What
matters is that you have decided it isn't good enough to use any more,
DirecTV is taking you at your word, and it was in your care when it
became not good enough to use any more.

I've run into some of the walls in my home because of motor control
problems, and I've done some damage. I don't own this place; I am
one of the people who rents it. When we move out, we're going to owe
money for fixing the walls. It's not like I purposefully destroyed
anything, and it's not like the walls don't still function as walls.
But the next tenant would complain if it were rented in this
condition, and frankly I would have too if it had been like this when
I got here.

If you rent an apartment and it gets damaged, are you not responsible
when you move?

If you lease a vehicle and return it trashed, do you not have to pay
a penalty?

I don't understand how your logic that because it is not your property
and you are paying to use it that this somehow exempts you (or your
father) from the responsibility of taking care of the equipment.

And the comment about buying a new remote and charging them for it?
