I have tried to be nice about this but it obviously has gotten me no where. I now feel the need to take it up a notch.

Since October I have been trying to get Discover to honor an agreement they had with me. I was a man of my word and paid my account in full even though I was having money problems at the time. I said I would not only bring the account current, but pay it in full if Discover would help me out by removing all the derogatory information from my credit reports. That's what the certified letter stated. If you check my file, you will see that I sent you a certified letter with a restrictive endorsement check stating that if Discover cashed the check, they agreed to the terms of the letter. The letter also stated that if Discover did not agree to the terms, they could alsways return the check to me which they never did. Now I'm faced with a decision because my credit is being effected severely.

Should I just let it go or pursue other alternatives to make Discover do the right thing. Before you say how it would be unethical or morally wrong to do, keep in mind that by cashing the check after reading the letter you mislead me into thinking you would honor my request. As a matter of fact, I'm sure any reasonable man could understand that your actions by cashing the check would be agreeing to the terms of the letter.

Enough is enough. Discover wether you want to admit it, made an agreement by cashing my check for over $15,000 without hesitation. I am terefore requesting that the following terms be met or I shall take all action deemed appropriate.

1. Discover will send me a letter explaining in detail how they are going to resolve this matter.

2. Discover will also send each credit reporting company that they reported my account to a request to remove any and all derogatory information that appears on their files.

I have been patient long enough. Please lets end this matter amicably.

Please tell me you did not just post your credit card number for all
the world to see.

Onward: Interesting tactic. "I will pay you what I owe you if you
don't report my account delinquent". Nice to know we can dictate the
terms by which we pay our own debts. Makes one long for the days of
debtor's prison.

My guess is that Discover's payments are processed by an automated
system that may separate payments from correspondence. That may
explain why your check was cashed.

My suggestion to Discover: demand payment in full right now.

You almost certainly have no case. A standard component of almost any
credit agreement is that they can accept any payment from you without
accepting any conditions you may try to apply to it unilaterally.

I'll bet if you check your Discover Card agreement, you'll see this
clause. It's almost universal. If that's the case, not only did they
not "mislead" you, they were as clear as can be.

Unless Discover concurred to your "agreement" in writing (which I
doubt they did), then their cashing your "retrictive endorsement
check" doesn't mean that they are going to do what you are requesting.
In fact, it is illegal for a creditor to report anything other than
the 100% truth to the credit reporting agencies, so they are unable by
law to remove negative payment information on your account. You owed
them $15,000 and sent them a check - - they were happy to get it and
deposited it and apparently your account is now paid in full.
Therefore, in their eyes everything has been resolved. You can take
all the "action" you want, but I don't think you are going to win this
one.

you should wite to planetfeedback and have them delte this letter for
public view for your own protection... you just gave out your credit
card # to anyone who uses this forum..not a very smart move on your
part...i would also call Discover to have this account now closed and
have them reopen a new one, if needed
