Dish Network Telemarketers Violate Do Not Call Registry and are RUDE

I began receiving junkmail (US Postal Service) on 7/12/06, 7/13/06, and 7/14/06, so far. On Saturday, 7/15/06 the recorded telemarketing calls began at 1:00 p.m., showing only Florida Call on my caller ID, along with the number, which I called, only to be disconnected as soon as the call went through. A second call came at 2:00, so I traced it online to Dish Network in Pompano Beach, Florida, from a caller named Sergio. I was able to locate a customer service number, which I called, and was told that they did see my number on the National Do Not Call Registry, but that they do not have control over their independent stores. A live sales rep called me at 2:32, and I asked him to stop the calls and he immediately hung up. I received two more recorded calls from "Sergio" at 3:00 and 3:30. I got another live sales rep named Scott at 3:53 (all of these calls are still on the same date!) and demanded that they stop calling, and he also immediately terminated the call. It is now 4:21 and another call will be coming shortly, I'm sure. As previously stated, I am on the National Do Not Call Registry, and these idiots don't seem to care. I have filed and sent a complaint to the Ohio Attorney General, but in the meantime more calls are sure to come until he contacts them. I have also filed complaints with the FTC/Do Not Call Registry after each call.

Do whatever you must to make this harassment stop. Actually, this should be considered a criminal offense under the stalking statutes, and if criminal action can be brought against Dish Network, I would be interested in pursuing those charges as well.

Try this one on for size. I was stupidly a dish network customer. The
last straw for me was when one of their reps gave my personal
information out to another customer so that she could call me herself
to let me know that her cell number that she wanted to use on her new
upcoming account was on my account information (of course it was
because someone there had typed the numbers incorrectly into the
system switching the last two numbers around.) The woman called my
home and informed me that dish was waiting for my call back so that I
could change the information. This woman called me three times. She
was given my full name, my address, and my home number because
apparently dish couldnt call me themselves? even though they never
tried, but they would wait for my call back once she called me?
wtf???

I received 10 calls a night after the time of 9pm by a third party
telemarketer. I am on the DNC list but they dont care, they just hang
up. When I filed the complaint they just say we dont even have anyone
working here by that name. Well finally the government has done
something about it. There was a $6mm lawsuit against Dish Network for
these business practices. They are being held liable for the companies
they hire to do these calls. I am filing a claim in the lawsuit. See

Here's a quick story of how I got at least one of the dish network
telemarketers to stop calling me.

I'm just as sick of it as everyone else, and every time I press 1 to
talk to an operator & tell them I'm on the DO NOT CALL LIST, they hang
up on me. So this time when I received a call, I pressed 1, the
operator answered, started his schpeal, and I said "YOU ARE BEING
RECORDED". This guy flipped out!!! He went off saying "That's
illegal entrapment you can't do that" over and over. I was just quiet
until he took a breath, and said, "Keep on talking". He huffed, hung
up the phone, and that's one less telemarketer that's been calling.

This experience finally made me feel like I had control over THEM.
Turn the tables, and shake them up anyway you can. Good luck, and
keep your chin up :)

Those spamers seem to be unstopable, they call and call, everyday:
"liz from dish network", "mike, digital installations", "satellite
tv", etc. I have asked them not to call number of times, but it does
not have any effect. Last week their representative
Bob had threaten me over the phone. Criminal network - one word for
them!!!

I am having the EXACT same problem they have been calling me for 2
months now. I tell them everytime to put me on their Do Not Call list
and they just hang up on me. I work from home and am constantly
hounded by Dish Network. I have signed up for the National Do Not Call
Registry. But what else can I do to get them to stop calling me and
being so rude.

I got a call today , from Andrea Dish Network and I said I am in do
not call list. she became rude. then asked for the her phone number &
office details, She started using abusive words.. MF* etc... I do
not understand whats the point in have a do not call list?

Does anyone know how to tkae this to court?

Over the past year and half we have received almost daily sales calls
from the Dish Network (Echostar Communications Co) even though our
home phone number has been listed on the National Do Not Call Registry
and the Texas DO Not Call Registry for the past three years. We have
told the Dish Network caller repeatedly that they have violated the do
not call law. They seemed not to care at all. In fact they seemed to
be foreign based (in China) and didn't even know such a thing as a do
not call list. For the first year, we reported each incident to the
National Do Not Call Registry website. Nothing happened. We
received no feedback or inquiry from the National Do Not Call
Registry. The calls from the Dish Network kept on coming. In
December of 2006, we filed a complaint with the Better Business Bureau
of Denver (BBB). Dish Network responded to this complaint. A woman
from the TCPA department of the Echostar LLC called me and requested
me to set up a sting operation to catch the caller. I agreed. The
woman gave me a fake SS# and a Visa card#. I did the sting operation
the next day on the new Dish Network caller. The Dish Network person
sent a letter to me and BBB informing us that they did an
investigation based upon the sting operation and was able to identify
the caller as someone from a company based in Maryland called Total
Marketing Solutions. In the letter Dish Network promised that no more
calls starting February, 2007. Yet, right after this letter, the call
kept on coming until today. I called the woman in the Dish Network
headquarters and told her that there were new calls and I did
additional sting operations on the new callers. I asked her to
investigate. She never did. Apparently they did the investigation
after the first sting operation just to be able to send that letter to
BBB to close the case. Once the case was closed, they would do
nothing to investigate the new calls even though they promised in
writing of no new calls. After two months I couldn't get any response
from the woman in the Dish Network who set up the sting operation. I
called another person in Dish Network whose name appeared in the
letter to me and BBB. I was told that the woman I worked with had
quit. I filed complaint with the Texas Department of Consumer
Protection, the Colorado Department of Consumer Protection, the FTC,
and the FCC. None of they seemed to be able to do or did anything to
stop the Dish Network from violating the do not call list. In the
middle of 2007, I had enough and filed a second BBB complaint. Again,
Dish Network responded to the complaint by doing another trace on one
of a dozen or more of the sting operations I did. They reported the
caller as one company based in California in another letter to BBB and
me. Again Dish Network promised to stop the calls after July of 2007.
Yet the calls kept on coming. I refused to close the second BBB
complaint and insisted that Dish Network explain what they had done
and would do to these law breakers and what measures they would take
to make sure the calls would stop. Dish Network ignored my requests.
After a while BBB closed the case and informed me that there was
nothing more they could do since BBB had no enforcement authority. It
seems to me that the Do Not Call list has no teeth at all. A company
like Dish Network can simply ignore it and get away with it with
abandon. Recently, we are getting calls every evening from Dish
Network at 7:10 PM CST like clockwork. I am pretty sure it is an
automated calling setup that just cycling through a phone list. I
don't know what I can do to stop them.

I have just had another call from Dish Network. They called every
month for the last 2 years. We are on DNC list and we have asked them
politely, then firmly, then rudely and then yelled at them to stop
called. It does not stop. I want to sue them. How do I go about it?

My home number is on a do-not-calling list. I don't get any
telemarkets calls but Dish Network for last 3 years. I have tried
multiple with them to take my number from their list but I am still
getting the calls. Usually, I get the calls from Indian telemartkers.
I have complaint to federal do-not-call list multiple times but it
will take some time for dish network to pay a big penalty for a class
action suit. BTW, I will never subscrible to Dish Network knowing
their marketing practices.

What do I do to help out! - I am tired of these calls also, I too have
tried everything and I'm continuely hung up on, lied to, and Dish
Network has turned their back. I am prepared to go as far as I need
to make sure others don't go through this. I record every phone
number that comes from these people...what can we do??

I have documented 12+ calls in less than 5 months from DISH
telemarketers and suing them under TCPA. I have no prior relationship
with DISH and am on the DNC registry. They claim to have no
responsibility for calls made by their authorized dealers. We'll see
what happens. Anyone out there putting a class action suit together
against DISH yet?

There are a few exceptions to the DNC registry, though.

First, if the company does business with you (i.e. I have
DishNetwork/Echostar) they CAN call you unless you change your
preferences by contacting them.

Second (and this one irks me the most), many telemarketing groups use
something called "predictive dialers" which just randomly call
telephone numbers in a geographic region. Since they are "blind
dialing" they have no idea who they are calling and thus have no
correlation to the DNC registry since there is no specific customer.
Basically they are just stabbing in the dark, hoping that maybe
someone they get on the phone will want to work with them.

I was quite annoyed that the local school district in my city made a
random call via computerized message to my house last Sunday at 9:45
at night, which is outside the legal "calling" hours. But sadly,
nothing will be done about it since it was a random dialer and they
just blame it on computer error anyway.

Hope you get the hassle to stop!

I've had the same problem with Dish and with Sears home improvement.
If you hang up and pick up again, the recording is still going
on....not only annoying, but could be a hasssle in an emergency
situation. I'm grateful i have a cell just for that reason.

Anyway do give the registry time to process your inquiry. It took
awhile for us, but the calls dried up in about three weeks. If you can
provide them with documentation, the companies involved may be subject
to fines, however, if you applied for credit in a store, then it
automatically gives them a loophole in the do not call law untill and
unless you report them. It's kind of implied that they may call you
for business reasons... and they include telemarketing in their
definition of "business reasons".

You say you lodged a complaint on the Do Not Call Registry site,
correct? If you complained in the correct way using the info they
needed, it should be resolved very soon. The calls just started on
Wednesday so you need to give the registry time to do something about
it. Also....has it been more than 30 days since you registered your
number? It takes 30 days for it to go in effect! Make sure you
register all your numbers including "ringmaster", second lines,
etc...., and cell phones.Good luck!!
