12 years and I am suspended and told I can never come back

Posted Tue December 7, 2010 12:13 am, by Leroy K. written to EBay

Write a Letter to this Company  |  Rate this Company

After 12 years ofselling, buying on ebay I have been suspended from these activitys. Reasons as ebay stated. I have 11 complaints in 12 years,in area off shipping, communcations and item problems. Now what is not said is return s where refunded, Most accounts I went out of my way to make the buyer happy. And the big discovery is NO ONE will ever be happy no matter how hard you try to correct a problem, I carried a 98% rating and really worked hard to keep my perforamance up to speed, Always paid my fees and ship as soon as I could. Granted sometimes I was away or took a few days to myself to regroup. But always came back ,refreshed and ready to start out with a new day on ebay. Always worked hard. Five years ago I was told that I had terminal cancer and had but lest then a year . I did take it hard but at age 55 I felt I had a full life., I was going to retire from police work, and keep up with my ebay to make extra money to help out around the house. Selling books seem to be the thing that was safe.Easy for my wife to despose of when I went to that great ebay in the sky. Well some good news is my doctor told me I was in remission and that was darn good news, Health problem with ashma, blood counts,ect.. that come with the cancer program, I have done well. I always thought that Ebay was a fun and pleasureable place to be during the long days at home while my family went about the lifes . You could say that it gave me a sense of well being, something to do. Granted they where days when I couldn't make people happy and days that health reason stopped me from being on line because having cancer alway make me tired. But I knew if I could just get on ebay and do what I called work would make the day run better. Now that is gone because ebay feels I am a poor business risk because one year out of 11 I failed to meet there high standards as a seller. being there 11 years with out any real big problem didn't matter. My rate of 98.6 and 11 complaints in 11 years was going to put your company down ? Somehow I find that very hard to beleive. A simple letter, phone call and a little help would have been accepted. But no in 5 minutes yousent me a warning, a rating and then a notices that I was suspended???? You have people with 80's rating still selling but I am a business risk at 98.6.
I just felt I should let you all know where I was coming from (The little guy) and what ebay was to me in my life until big business took over a nice place to work for ones self and made it worse then I truly beleive the founders wanted it to be. You can be big but it was people like me and many many more that got you this hi up the ladder. I served you, I served your country, I served as a protector as a policeman. But why did I never earn your trust
Thanks ebay for the years I was there you did mean something to me and my family but now I got to tell them perhaps I was wrong in trusting my well being to what is now a mistake in my behalf.
I would like to say it was wonderful but, I just can't and feel right about it.
sincerly
Bigdog1lee
Leroy L.
some day I would like to see the old ebay and return. I really did try to keep up, but it was only a thing I enjoyed doing

It's fairly easy to get back on ebay after being suspended. Google
it.

First off, this is why the entire "Boycott EBay" effort has been
ongoing since Feb. 2008.

Second, eBay does not care about you. There is a myth that people seem
to think eBay ever did. No, they never did. Well, not since I first
joined back in Sept. 1998.
What eBay cares about is money. And today they only care about sellers
who list $500,000 per month. Diamond Powersellers.

Third, since you don't list that much, eBay does not want your
business. They merely put up with you, because it's pennies in the
bank. (Never mind the fact that since they give Diamond PS's free
listings and lower final value fees, they make more off you).

Fourth, DSRs must be maintained at 99.5 or higher to avoid being
suspended. Also, if you have negative reactions equal to or greater
than 10% in a 30 day period, you will be suspended. EVEN IF YOU ARE
INNOCENT! But, are you completely innocent?

Finally, there's a boycott going on. WHY are you buying or selling on
eBay?

Hey big dog, As an ebay customer I always look at the ratings before I
buy, but I have had negative experiences with sellers who are rated at
99+% (I am still waiting for a replacement mp5 player and it has been
since April. I got ripped off. I would love to hear how ebay decides
to suspend a seller; I'm saying I would like to hear the other side of
the story. Also sometimes when sellers ship it is not fast enough, so
if a seller puts in the listing they will ship within a specific
length of time the customer will know what to expect. For the most
part I recieve my shipments within one week. Good Luck Dog

What you're supposed to do if your rating is dropping is set up a few
fake accounts, buy some of your own stuff, then rate yourself throught
the roof. Duh, that's how it works.

I'm no fan of ebay since they started focusing only on policies that
screw the seller, but after seeing this thread and the replies of the
OP both on his page and this thread, it sure goes a long way in
helping me realize why they did it.

based on this
http://toolhaus.org/cgi-bin/negs?User=Bigdog1lee&Dirn=Received+by&ref=
home the Op has consistenty shipped paperbacks when he said in the
listing the book was a hardback and consistently packed books poorly

That alone would make me hit the back button. combine those things
with his responses to buyers and of COURSE he had issues

I use toolhaus on every item I am thinking abut buying. It gives a
very clear picture of who the seller really is.

When I first read this letter earlier this week, I misread the title
as "12 years old and I am suspended...." I started to read it and was
all set to be on the side of the OP, mainly because I like when
nonadults use this site. We've had some young teens post here and
they have been cool.

I realized my mistake when I was reading the letter and did the math,
and realized that it couldn't be a young kid.

And yet....

"Trying to keep up" is not the best in customer service. If I was a
buyer I would also give honest advice/feedback. The masses have spoken
and three strikes you are out. Although sorry for your circumstances.

I've read through the responses here, the feedback on toolhaus and I
believe I can now make a full and frank response. I've ignored your
letter, as I don't believe cancer is an excuse for anything. I have a
few chronic illnesses and I have never used it as an excuse for bad
behaviour, let alone laziness or slacking off-I pull double my weight
around at work and I generally hand in my essays at uni either on
time, or late but I always follow the proper channels first.
As for your ebay performance, I would have to agree with the others. I
do not have an account on ebay, and to further add to that, I'm in
Australia (not the US-this website does not have Australia as a
country option), so saying I'm an employee won't fly-complaints that
stay within the US don't generally tend to involve Australian folks. I
do know how the system works however, as my family uses the website
regularly to buy musical items/games and to sell off stuff we no
longer need. Everything has gone smoothly-nothing has been lost, items
have matched description the list goes on. How many of YOUR items get
lost in the mail? Too many by the sounds of it-that is not normal for
the average citizen and unless you can prove it, couriers/postmen do
not single out people's mail to lose. They also do not damage items to
the point that your buyers describe. Really, you do not have a leg to
stand on.

by bigdog1lee Posted Thu December 9, 2010 @ 10:10 PM

I am sorry, but what you have stated is not correct. The notification
I received said I was restricted indefinately - unable to list
(several listings I made that day were removed), unable to sell,
because of low customer ratings (3) that complained of shipping and
product confusion (selling LP albums where customers expected CD's -
description stated in three places I sell LP records - money was
refunded when product returned). Problem of shipping: (Ebay) sets your
own shipping charges on books, tapes, ect. These charges do not exceed
$4.00 per your own limits set by you on your site., we the sellers do
not have any ,I repeat ANY control on shipping charges. With that said
lets go to item two. Even on the dash board, one can not read what a
buyer has written or complained about. So if there are complaints, we
as the seller do not get to read the complaint. This practice is also
set up by you, EBay, to the buyer, and we as the seller have to take
your word for what you say the buyer told to you. We get a percentage
report telling us we are down in an area. Let's discuss the area of
shipping. That brings me back to the limits for shipping costs set by
ebay, you said I overcharged for shipping, yet you set the limits to
$4 for shipping costs. If it costs me more than $4 to ship the item,I
the seller have to foot that cost loosing profits. Most books sell
for 99 cents (per the suggested Ebay price), if a book weighs more
than 3 pounds I need to absorb that cost Plus pay the Ebay's fees on
the total sale that includes shipping. So, after 12 years selling and
buying on Ebay and with only 11 complaints that could not be settled
because the buyer would not engage or out right refused to engage in
settlement talks, I would not consider that bad but maybe an avarage
score for a small seller such as myself. Communications you stress is
important between buyer and seller, but even in the corporate sales
world not everyone can be happy. So when one can't settle or talk to
a buyer about a problem, no matter what, Ebay will side with the buyer
and basically let the seller take a hit even if the seller is in the
right (not being able to communicate because the buyer refuses).
Ebay goes by numbers in most cases and overlooks the real facts. Yes
the customer is always right in the perfect world, but today's buyers
and sellers don't live in the perfectworld, numbers are just that
numbers. Facts is fact. If a buyer buys a book for 1.00 and gets it
shipped to them for 4.00 or 3.99 its a deal, but that book has to go
through a 3rd party, the USPS, to be delivered and media rate allows
up to 14 days to get to its destination (per the USPS guidelines) -
some buyers get upset with this possible long time shipping. Here the
rules set by USPS on their shipping is not taken into consideration by
Ebay, even though Ebay recommends sellers use the USPS. When the
window area set for shipping are examined from the time that the buyer
payes for the item, that Ebay informs the seller, that the item is
placed in the delivery system, then add in USPS time for delivery (of
which we the seller and ebay really have no control over) the the buy
to receive time may add up to more than the overall standard time for
a complete transaction allowed by Ebay. Some items make it within the
window time, and some don't. USPS delivery time is not within the
seller's controll, neither are high volumn shipping times such
Holidays - the slowest time of year for any shipping/Mailing company.
I could go on with thousand of reasons, but I feel as long as I have
been with ebay ebay should know as well as I do how problems with
buyers can come up. Even those buyers who have begun to use Ebay as a
means to scam the sellers, something Ebay has never warned not
considered when dealing with certain buyers that sellers must accept
bids from. Even the national news carried information on this
activity - yet it has never been given consideration from Ebay. I am
but a small ebay vender, yet I sell a good amount, and have been loyal
to ebay for the whole 12 years. Yet Ebay claims that 11 unresolved
complaints over those 12 years is a good enough reason for them to
terminate our relationship and to be kicked of he Ebay site. Again I
bring up the seller that has less than the 95% rating yet they are
still on your site selling. That is one of the biggest reasons I
question your business decision to kick me off. And from what I have
read on this site alone, you really do not fall under your own
business ecthic and standards.
Your responce to me is a bunch of nonsense, it really does not answer
for or explain your actions. Still you have not answered the question
why? and who made the decission? In fact the person who replied (Dave
Smith Office of the President-) does not even tell me who you really
are. On the ebay sites your name can not be found. I do believe my
letter was addressed to The President of the company not Dave Smith.
I was expecting to hear from the President himself - doesn't a 12 year
relationship entitle me at least that priviledge? Sincerely
Leroy L. Kimball

Hello,

We received a copy of your recent email via Planet Feedback and would
be happy to be of assistance to you.

Upon receiving your email via Planet Feedback I reviewed your
‘bigdog1lee’ account and found that it was restricted rather than
suspended. I hear your concern with not being able to list more on
eBay and would really like to help you resolve it. Let me begin by
explaining why this selling restriction was put into place. According
to the last evaluation of your DSRs, you're currently not meeting the
minimum performance standards that are necessary to sell on eBay.
Here's more information:

http://pages.ebay.com/help/policies/seller-non-performance.html

When this happens, a selling limit is applied to your account. You can
view your DSRs as well as any open Buyer Protection cases and
information on your limit through your Seller Dashboard. Based on the
percentage of 1s and 2s on your detailed seller ratings, your buyers
have expressed some concern about your listing descriptions,
communication and the shipping and handling charges on your listings.
While I can certainly empathize with your frustration in this matter,
please keep in mind that eBay has created the DSR function to build
confidence and trust in the eBay community. As a result eBay does not
edit or moderate DSR ratings on the site under any circumstances. This
approach is essential to creating a public and transparent trading
environment for both buyers and sellers on eBay. The only exception to
this area of the site applies to the ‘Shipping and Handling Charges’
DSR in those instances were a seller offers free shipping. In order to
maintain a safe and productive trading environment eBay does take DSR
scores very seriously, as indicated in the before mentioned policy.

Thanks again for contacting us concerning the current limit on your
account. While I realize this may not be the exact message you were
hoping to receive; I wanted to explain why this limit may be in place
and what it means.

Regards,

Dave Smith | eBay | office of the president

this ebay user ID does not show "No Longer A Registered User" like

While I'm in agreement that some of the responses to the buyers were
less than empathetic (or even polite - "You can't fix stupid?"
Really?), there were less bad than good.

Might want to contact them and find out if this is, in fact, a

So I checked out the link provided to his feedback (thanks to the
poster that listed it) and it was full of negative feedback! I
wouldn't buy something from this guy with someone else's money!! He
seems to have numerous issues with things he sends out and while
sometimes people don't contact him first their issues were really
caused by him and shouldn't have been an issue in the first place.
This is the type of seller that that really gives internet auction
sites a bad name. I've had some issues with some used items (mostly
dvd or blu ray discs) and have always had the issue corrected by the
sender. On Amazon I had issues with a couple and the seller always
gives a full refund and doesn't require the item shipped back.
Gohastings is great about this and I always reorder the item from
them. His feedback was horrible. He had listed back to 2003 over 60
negative feedback and over 70 listed as neutral. It's not 11 in the
last 12 YEARS as the poster says - that's just in the last year
according to him. He should have been suspended as a seller because
his actions damage the Ebay brand!

If you sell books try Amazon. My husband has had great success. If you
are going to be on vacation or otherwise unable to ship in the time
required, you can put your account in "vacation" mode. Your items will
not show up for sale.

I am sorry about your illness, and hope you continue to do well.
However, selling something enters you into a contract. You need to
ship in a timely (to the seller) manner. If you can't do that you
should not be in that business, or at least take a break when time
does not allow for it.

Sorry to hear about your health problems, but ebay has become very
buyer-centric and you have evidently left a lot of unhappy ones.

Ebay doesn't know or care about your bout with cancer. Neither do your
buyers. Sorry, but that's how it works these days.

Now granted the one guy who used "Neutral" to say "Thanks" to you
kinda sucks. So I'd say you could really call it 10 marks instead of
11.

However I am not sure if how long you've had your account will prevent
them from investigating - or closing an account - when the marks in
question are only a year old.
