ebay seller electronic-penny is a fraud

I want to complain about an Ebay seller that is keeping my money. Four months
ago I bought an Iphone 3g in Ebay website and I received the item with audio
problems, I got in contact with the seller that asked me to return the item
and they promised to send me another in perfect conditions. Well, it's going
to complete 4 months and they didn't send me anything. Here are the
informations: ebay seller electronic-penny, item is NEW Apple iPhone 3G - 8GB
- Black (Unlocked) Smartphone USA SELLER (300675341546),Sale date:
03/07/12,price paid $247.90, they are located in NEW YORK, BROOKLYN! My name
is Higino Oguro, american citizen. Please help me to recover my money or the
item,thank you.

Hi,Here is the tracking information for the replacement :9405510200829379634199. It seems that USPS has yet to scan the package so we will contact them to find out the issue.

Hi,We sent the replacement over a month ago and the tracking number didn't update, did you receive the unit? if you didn't then I'm afraid USPS may have lost it. We are willing to send another unit but would you please cover at least 25% of the price? we will cover the other 75%.

I want my iphone or the full refund of my money within a week. I will not pay extra 25% to share shipping expenses if the item was sold with free shipping.

This buyer purchased the unit from us in March used it for about two
months then returned it for a replacement. We sent a replacement once
the first unit was returned to us, buyer contacted us about a month
later and stated that he didn't receive the replacement, the tracking
number didn't show that it was delivered and we deemed the item lost.
We did ask the buyer to cover 25% of the loss but he refused, we
couldn't get into any terms of agreement so we've refunded the buyer.
Terrible experience as a seller, bad experience as a buyer. We
apologize but we've done everything that we can, buyer was not
responsive and the delivery courier didn't help the situation. We've
had over 50k successful sales on the internet as a company, we've
never had an experience like this.

We never refused to replace the unit, we never refused to refund the
buyer, at one point the buyer was sending e-mails stating that he
wants a refund, followed by another e-mail(within hours) where he
wants a replacement, then back to "No I changed my mind"

Refund applied via paypal.

Do NOT buy 2nd-hand electronics.. expecially on ebay

This is fraud. If Paypal wouldn't cough up, you can file with your
credit card company. Oh yeah, you let these idiots string you along
for months and it may be over the limit. Hmm - whose fault is that?
The time limit is generally 45 days to file with either Paypal or your
credit card. If you used Paypal balance to pay you may be too late
and then some.

Since legitimate sellera are already being scammed by buyers taking
advantage of this, I don't recommend extending it. However, since
this is a fraud case they might help you anyway. Paypal only seems to
like giving money back when it abets a scam though, so good luck.

This is a scam, I have encountered this before. If the item was
indeed lost in transit it should be covered by the shipper 100%,
esspecially on items worth over $100.00 (which your supposed to tell
them if it is).

If the seller failed to do this or buy the insurance he is 100%
responcible. As for the his other line "the tracking number didnt
update" what is that??? you get a new tracking number for every
transaction you do. There is no updating that needs to be done.

I would report them to ebay and do a report through paypal.

if you attempted to go through PayPal or eBay and, if so, what they
had said.

Also, are you just now reporting this, or have you been letting eBay
and PayPal know all along that this jerk stiffed you.

If you wait too long, thinking they will make it right, you might be
out of luck to get reimbursed.
