Good faith and fair dealings complaint

I believe The Ford Motor Credit Company has breeched the good faith and fair dealings law within my contract. My car was repossessed on Sunday even though I had made June's payment, plus my late payment on June 8th. I was only late on May's payment and had not missed a payment since buying the car. I paid online on June 8th, 2012 and then received a confirmation email that my payment (for both may and June) had gone through (I have proof of the email). I then left for vacation and a children's camp. When I returned home I checked my Ford account to make July's payment and realized none of the payments went through-even though I had an email confirmation. I paid the very next day and the following day my car was repossessed. I called and Ford has no explanation as to why the payment didn't go through. They said I probably entered in the wrong account number online or possibly the bank entered it in incorrectly. If this was true I shouldn't have gotten an email confirmation because I didn't think of the matter after the email. Now I am having to pay late fees, the repo charge, they might drop my extended warranty, and they're reporting late payments to the credit bureau. I tried to talk to a supervisor, but no one will return my call. I feel as though I am being punished based on faulty technology on Ford's part.

I would like to receive my car back without any additional fines other than the late fee for May's payment. I do not want the repossession reported on to the credit bureau. I have proof the Ford Credit received payment on June 8, 2012. My Ford Account also stated the payment went through at that time. I would like Ford Credit to return my car without additional costs or reports to the credit bureau, and I would like Ford to honor my extended warranty.

FTC says it can be legal. Right in the first paragraph too.


It depends on the state - and Texas IS a state that allows
repossession of vehicles where the payments are constantly late.

Is this a vehicle you just purchased? I have friends in the repo
business (omg the stories they tell!), and if you miss your first
payment on a vehicle, it's automatic that it gets repossessed.

Sounds like you were constantly late. You paid May the same time you
paid June so you were at least a month late with that. And as asked
below didnt you notice the money never left your account?

I dont think Ford owes you anything, they did what they needed to do.
If you were late once I would be on your side, but it sounds like you
were rarely on time.

Email confirmations mean nothing, it only matters when it leaves your
account.
