Termination of Contract

I terminated my membership to Gold's Gym in Florissant, Missouri in July 2010 within the deadline. I recently discovered (June 2011) that Gold's Gym apparently did not terminate my contract and has been withdrawing the monthly fee from my credit union. I talked to the manager by telephone and she said she would talk to "corporate" and get back to me the same day. Another person contacted me that evening to say she hadn't heard from "corporate." The past three days she has been unavailable.
Gold's Gym needs to refund me the money taken out of my credit union.

What Gold's Gym was illegal. Shifting the blame to me (because I did not notice they were continuing to take out the monthly membership fee from my bank account after I terminated my contract according to their directives) is not the point here. I do want to thank PlanetFeedback because after one week, I did receive a check from corporate headquarters. With your help and one more phone call from me to Gold's Gym, threatenting to call the local news about their illegal tactics, I received a positive solution.

at least you had the funds in your credit union to cover the fees, but I have a feeling you're gonna have a battle with this one. You said nothing for almost a year and you had previously given them access to that account. You inadvertantly gave them your blessing to keep doing it by not noticing.
Gold's won't likely lift a finger to help you. As far as they are concerned, it's your fault and your problem (as slimey a practice as that is). The best you can do is to try and take it up with your credit union and see if they can/will intercede on your behalf to make them return the money. You should take all of your cancellation and contract paperwork in with you as you will need to prove that you stopped your membership and that they were supposed to cease the automatic payments.
You might even need to look into legal action, but again, the cost to do so may be prohibitive and it will hinge on whether you kept all that cancellation paperwork to prove your case.

I'd be on your side, but not looking at your bank account statement for a year pretty much, well, I think you lose the battle with that mistake.

How is it that you have not noticed these withdrawals for a year? I doubt they will refund all your money after such a long time. Good luck.
