I should mention that refills are NOT free at every restaurant. I think this is where to consumer has to beware and not make assumptions.

In this case, I have to agree with the other posters; you ordered one beverage that apparently was fine and decided to switch to another one. This is not considered a refill; it is considered a new beverage. I would consider this a lesson learned.
