INFERIOR SERVICE AND DEFECTIVE EQUIPMENT; UNLAWFUL EARLY TERMINATION FEES
by shannon s. - Posted Sat May 12, 2012 @ 8:15 PM

In December of 2010 I signed up for wireless internet from T Mobile and given the Rocket as the wireless device. I was told that I would have 4G service in both Lake Worth, FL and Miami, FL where the device would be used. This was also verfified by the "coverage" chart. In less than two weeks I was already having problems with the service. Called Customer Service and was told to take the device back to the store and get a replacement. Did that and still had problems. By this point I am already locked into contract. I called AT LEAST ONCE A MONTH complaining that I was not getting coverage in Miami and that the coverage in Lake Worth was average. Everytime I talked to CS they "put in a service report" to check the towers in the area and they also did a speed test. In that time I had to replace the device again because after speaking with a manager and informing her that I was going to cancel my service and NOT PAY AN EARLY TERMINATION FEE because of defective equipment and inferior to complete lack of service. She said that after the device was replaced and the service was still bad she would "prorate" my contract. I told her that was not acceptable and reiterated to her again that I would not be paying an ETF as T Mobile was breaching contract. I also called yet again to CS about the non service in Miami and was told "sorry but there are no plans to fix the service in that area." Really?!? Now there's false advertisement along with defective equipment (Lemon Law) and the breach of contract. Oh and guess what, the service in Lake Worth was becoming just as bad as it was in Miami. I DON'T LIKE PAYING FOR A SERVICE AND NOT RECEIVING IT! So guess what T Mobile. I stopped paying you. You don't like it??? So sorry, but I have no plans to pay you any additional monies. What you are doing is unlawful! Now you want to try and charge me an ETF and threaten to turn me over for collection. I don't think so. YOU LOST A CLASS ACTION LAWSUIT IN 2009 FOR ETF'S!!! Pretty sure people don't get paid if they don't do a job, so you're not getting paid for a service you did not provide! I have signed up to join a class action lawsuit against you. Perhaps I'll get back some of my money that was wasted on poor equipment and no service!

Cancel and close my account, marked PAID IN FULL. Actually, I'd like to have some of my money back. I paid my bill every month even when the service wasn't working.
