I am guessing you are going to have to prove you actually wrote this check before you get it back. Do you have a copy of it? Was it cashed? If it was then you should have a copy with your bank that proves you had that much money in your account and the check was cleared.
Not that I believe this story at all...but just in case you MIGHT be telling the truth.

To me it seems as if maybe it was a check given to HER that accidently made it's way into the envelope. Like some sort of settlement check or proceeds from the sale of a home... something of THAT sort. If that is the case I would suggest you contact the issuer. They can put a stop on the check and reissue it to you.
Anything that gets sent to Cingular becomes their to dispose of. If it arrived with a payment and wasn't payable to them, they likely destroyed it.

This reminds me of the time I accidently sent my birth certificate, SSN Card, and 10 new $100 bills in an envelope with my Columbia Records 10-for-1 CD selections. I really enjoy the music, but I never got the other stuff back...

You know I did this exact thing last month. Not only did Cingular return the money to me, they also included the interest that I lost because the money was not in my savings account. That was very nice of them so I decided to sign a 5 year contract with Cingular.

Wow.
You accidently sent $10,000 to a cell phone company. Instead of calling the bank you used PFB. I like your style.
Most people don't know this, but the new mods are also wise guys. If you don't get the money soon, Erik and Venice will start breaking thumbs. If that doesn't work, oh man, Greg might pistol whip the snot out of them.

Oh come on! I've done lots of stupid things in my life, but "accidentally" sending a $10,000.00 check to a utility is NOT one of them.
IF (and I am very dubious of your claim at that) you did indeed send them a check for that amount, the first thing I would do is call my bank and place a stop payment. It's usually about $25-$30, but at least then you know that no one could cash it.
I have to ask, though, how do you "accidentally" send a check like that to Cingular? Was it an endorsed check from another source, made out to you, that got placed in the envelope or did you actually, physically, write out a $10,000.00 check payable to Cingular?
I also can't imagine Cingular refusing to return the check to you if they do have it and it is indeed your check. That is not their property and they would have no reason or capability to keep it.
I would think that someone who has this kind of money at their disposal would a) be more careful and b) know what to do in the event a "mishap" like this occurred.

I had a similar problem when I accidently mailed my mint-in-package 1938 Action Comics #1 comic book in with my cable bill. Boy, I had a heck of a time getting them to send that back to me.

So... did Cingular cash your check? Or are they just keeping it instead of incurring the cost of returning it to you?
Save yourself a lot of worry -- put a stop on the check ($25-$30 for peace of mind).

Your letter needs more information. Not necessarily for us here at PFB (though it would be nice so we could have a better understanding of the situation) but for those at Cingular who will be in receipt of the letter. It probably should have gone something like this...
To Whom it May Concern,
My name is _______________ and on October ___, 2006 I sent a payment to Cingular in the amount of $_________ for account #________________. It seems I included a check, written out to ______________, in the amount of $10,000. I would very much appreciate it if you would return the check to my attention at the address indicated on the check as soon as possible.
If you have any questions regarding this matter, please feel free to contact me at ____________________.

OR:
To Whom it May Concern,

Now, my question is why on earth you'd even write a check out to Cingular in the amount of $10,000! If you didn't write it out to Cingular you have nothing to worry about as they won't be able to cash the check anyway.
Let us know how it turns out. $10,000 is nothing to bat an eye at, that's for sure!

Was the check made out to Cingular? Or was it made out to someone else?
I'm assuming the later. I'm assuming that they received the check and threw it away (or something similar). Which is why they aren't returning it.
Your best bet, if they've claimed to have destroyed it, is a stop payment. The problem with that is that the check can become reactivated in a few months.
If I were you, I'd call my bank and explain my problem. Say that you made a mistake sending the check to Cingular. Indicate that they refuse to return or it show proof of destruction. Ask if there is any way for you to permanently stop payment on the check.
As a last resort, I suppose you could file suit against Cingular. It is illegal (I believe) for them to hold property that does not belong to them. Specifically, if the check is not made out to Cingular, they do not have a legal right to hold it.
Or, did Cingular apply this as a $10,000 credit to your account. That'd be cool. You wouldn't have a cell phone bill for, what, 10 years. Seriously, a refund would be in order, although I'll bet they'd drag their feet and it's take a couple of months.
Or, are they claiming they never received it? If that's the case (and I'm guessing it is), you're goingt to have a hard time. See "stop payment" and "ask your bank what to do."
