Traffic Summons received Jan 22, 2008

I was pulled over by a police officer in Pulaski County on January 22, 2008. This officer wrote me a ticket for speeding 10 miles over the limit. Of course i have the opportunity as a citizen to represent myself and dispute this charge in court, however i believe it is known, and perhaps fairly common practice in this jurisdiction to pull over drivers who live out of state in an attempt to produce revenue for Pulaski County, knowing that those charged will not be able to attend court at the requested time/date because it would just be completely unreasonable to travel that far of a distance to fight such a charge.

I am informing you that I will be researching my options with federal authorities in an attempt to open an investigation to see if this jurisdiction is unfairly targeting out of state drivers and ticketing them for the purpose of producing revenue for this jurisdiction in Virginia. Through research, it is believed this practice may be happening in certain jurisdictions throughout the state of Virginia.

Okay, but were you speeding? If you were speeding, you have to pay
because you broke the law, even if it was just 10 miles over the
limit. If you were not speeding, then I'd be there with you, but the
laws apply to everyone.

I'm going to go out of a limb and try to get inside Robert's head.

Let's suppose that there is a robbery going on. The police arrive and
find two people, caught red handed. The police arrest the African
American suspect, but let the white one go.

I think Robert thinks that they should stop EVERY speeder, not just
select ones. A he believes that "it is known...fairly common
practice" for the police to use nondiscriminatory tactics.

probably being off your meds. Very funny though!

You for real? You were speeding dude. Pay the ticket and move on in
your life. You don't think they get bogus letters like this by the
truck load?

This is absurd. You were speeding. You broke the law. You got caught.
Grow up and act like a responsible ADULT and pay the fine.

You ought to be taken outside and beaten for wanting to waste the
Fed's time even making such an absurd, unwarranted complaint. Look,
you got caught with your hand in the cookie jar. It isn't the crime of
the century so don't make it into a Federal case. Pay the damn fine
and slow your lead foot down.

Pay the ticket and get over it. As the cop said if you are rude the
officer can be rude and give you a ticket. I got stopped in WV for
going 15 miles over the limit on a highway speed limit was 55. The
officer asked me if I knew how fast I was going and I said about 70.
It was about 5am and he gave me a warning ticket. I have never gotten
a warning ticket and I asked him what I was suppose to do? His reply
was tape it to your steering wheel and slow down.

Wow. All of this to get out of a speeding ticket? Sheesh. Please
please please if you go to court and represent yourself and start
accusing the police there of doing anything questionable tell me
you'll get the whole thing on videotape! That would be my favorite
youtube video ever I bet.

I bet they really appreciate your informing them about you
"researching your options" about opening a federal investigation into
the matter. Please get that on tape as well, as that should also be
some fun listening!

Let's see some of that research while you're at it.

Oh, and one other thing--WERE YOU ACTUALLY GUILTY OF SPEEDING????

So, tomarrow is the big day you'll get pulled over. Maybe now that
you've seen into the future, you'll be smart enough to not speed and
get pulled over.
Fat chance huh. Well kind of like the chances of you getting out of
this ticke.

to avoid the ticket? Someone told me that happened to them. Like the
cop pulls you over and says that instead of a speeding ticket, they
can let you pay 100.00 dollars instead. And I'm guessing that goes to
the state funding for something or other.

Welcome to the great state of Virginia.

I've had conversations with state troopers about "targeting"
out-of-staters. The state on the license plate makes no difference
and a trooper will pull anyone over for speeding. In fact, I received
a ticket in Surry County about a week ago for doing 8 over the limit
(63 in a 55) to get to the ferry on time. It was MY fault-- but
perhaps I can fight the ticket at my court date on 12 February. Oh
wait... I'm pregnant and my due date is 5 days later.... So, I'm going
to research my options with federal authorities because the trooper
targeted an obviously pregnant woman knowing that I'd pay the ticket
because I might not be able to show up to court.

State troopers in Virginia are notorious for cracking down on speeding
on the interstates. Interstate 81 runs through Pulaski County, so I'm
assuming you were pulled over there. I despise driving on I-81
because of the speeders. Is 65 not fast enough? (Same with
Interstates 95 and 64. *shudder*)

Wow...guess this should scare the living crap out of them huh? I am
sure they are pulling in all their traffic officers at this very time
and putting them all on suspension for being so unfair.

Can you please forward this letter to include ALL jurisdictions in the
entire USA or are you just starting out small and working your way up.


Either pay the fine or please not guilty in court.

I would just like to add, that in Virginia, they have a new law saying
that anyone driving 20 miles an hour over the speed limit are
automatically assessed a $1,000.00 fine, charged w/ reckless driving,
and are forced to pay the reckless driving fine. BUT, anyone pulled
over for doing the same from out of state, is NOT charged the extra
$1,000.00 fine. So, you cant complain about one, and then want to
take advantage of the other. So, consider yourself lucky if you ever
get pulled over in VA for going 20 over

Good luck with that.

They are cracking down on speeders all over the place. While you do
have the right to defend yourself (I always fight tickets... and get
cut slack on most of them) I always get a feeling that there is little
sympathy for "reckless drivers" although i must say - i am much more
afraid when i see a 80 yr old woman in a buick blindly pull out into
traffic then i am seeing someone going over the speed limit.

You dont say what state you are from, but either way 10 mph isnt that
big of an infraction. in PA i think thats only worth about 2 points
and about 150 dollars. It could have been much worse! I dont even
think you get points for out of state tickets anyway - i got pulled
over in jersey for going.... i think 20 mph over and i didnt get any
points here in PA.

There i go rambling again.

I'm not surprised in the state of Virgina though, even though you were
speeding. A few years back I was traveling on 95 North through VA and
I was pulled over and given a ticket for going 60 in a 55. That was
just rediculous to me....

Really? You think you were pulled over because you are out of state,
and not because you were driving 10 miles over? I am sorry to burst
your bubble, however, even IF (and thats a BIG if) you were right, you
were still speeding; therefore, you have no ground to stand on. Even
if they pulled you over because of that reason that you stated, they
still can say you were speeding, so there! Nothing illegal there.
What IS illegal though is you speeding and going over the speeding
limit. Also another thing that is illegal, is speeding in a state in
which you don't live! Come on, I am not a police officer and I could
have told you that was a bad idea!!!! As any responsible adult would
do, you need to cut your losses, and learn from your mistakes. Don't
speed because:
A: you can kill yourself
B: you can kill someone else, if not yourself.
But I am sure you have heard that, so there is no reason why you
shouldn't listen.

The fact that some people get away with speeding doesn't mean that
everybody should, and I don't know of any nondiscrimination laws that
protect non-locals.

If you can't even claim that you weren't speeding, then it doesn't
matter how close you are to the courthouse: pay the ticket.

Why write this letter? How does it help?

If you really believe there is an issue here, then writing this letter
will accomplish nothing. Contact the "federal authorities," if you
wish. But don't write letters like this since they are just threats.

By the way, if you REALLY feel that the county or Virginia police are
acting in an inappropriate way, your first avenue would be internal
affairs.

Having recently received a ticket (my first!) in Virginia (I'm a
resident), I'm aware that the back of the ticket has a phone number to
call if you believe the officer acted inappropriately. It makes
certain to note, however, this this will NOT excuse the ticket.

In the end, if you were speeding, you do need to pay the ticket. If
you were not, but cannot represent yourself in court due to distance,
that's quite another story.

So, Robert, were you speeding? I was and that's why I'm paying the
fine. And the court house is only minutes from my office.

Pay the ticket already. You were speeding and you got caught. It
doesn't matter if you're local or from out of state.

My husband got a speeding ticket in Currituck County, NC (we're from
NY). We didn't whine and send letters. He was over the limit and we
sent a check to pay the fine.

Be happy you got a ticket in another state so it doesn't go on your
license.

Well, if you can see into the future..then maybe you will watch your
speed at the same time and place as it occurred.

Seriously..when I got pulled over several years ago about a mile from
my homestate line for going maybe 5 MPH over the limit, when the Ohio
cars were passing me up and none of them were pulled over, I received
my ticket for about 65.00. So, pissed as I was, I didn't fight it, but
sent them 5.00 a month until it was paid off. What could they say?
LOL

It happens all over...pay up and continue on, watch your speed in the
"future"......

Thanks for the chuckle, Robert. There's no such thing as
"discrimination" based on state of residence. So if cops want to
ignore everyone else on the road and bust the out-of-towners (ever
driven through Pennsylvania?), they can do that.

Be a grown-up and pay your phone and move on with your life. If you
hang on to everything to this degree, you're going to have a rough
life ahead of you.

As a speeder. It isn't as though people going 10 mph over the
limit are generally given free passes. It is more like 5-7 mph,
generally speaking, on roads with limits 45 mph and higher. In a
lower zone, it pays to not go more than a few mph over.

I drive 7 mph over the limit on highways if I want to not worry that
troopers are around. I have found you can cruise right by at that
speed. If I am drving 10 mph or more over the limit, I keep a sharp
lookout in the places I expect troopers to be lying in wait. Of
course I slow to my normal 5-7 over once an officer is seen.

As a coincidence, the last speeding ticket I got was in Virginia. I
was an out of state driver. I was going 10 mph over and it was dark
and an unfamiliar road, so I wasn't shocked when I got a ticket. It
never occurred to me to go back and fight the ticket, because I was
speeding. What defense is there to that?

This is a consumer website, not a legal one.

& you can't get out of a traffic ticket by sending an email. That's
just crazy.

You were 10 mph over the speed limit, is it really worth risking a
bench warrant being issued over that??
