My brand new i pod nano is very defective

I purchased a 3rd generation i pod nanao and i haven't even used it for up to 14 days
I purchased it before Christmas and started to use it a little over a week ago. It suddenly went blank last week and it wouldn't respond when i tried to use it. I took it to best buy and they said that they couldn't help me if they didn't have apple care. A nice guy at geek squad helped me. It has happened 2 more times since and mysteriously started back up. I treated it with utmost care and it never got bumped or dropped.
I want apple to take responsibility for the defective merchandise they sold to me and fix or replace it.
