Your unwillingness to settle this matter is in the process of being sent to EVERY single one of Sears' Investors aand Affiliates. It is also being broadcast LIVe on You-Tube, where Millions of Viewers will see it. The Media will be hit today, along with the Consumer Advocate websites.

We are asking for a $3,000.00 Settlement from Sears to cover the costs incurred by their Auto Repair Service - after which, we will NEVER patronize a Sears Facility again as long as we live.

However, until this matter IS settled, there will be a NUMBER of people who will share the same attitude. I have directed all inquiring minds to you, to find out why you refuse to settle this matter, which you would have done IMMEDIATELY - the world knows, if we were WHITE ... like you.

This email is also being sent to others.

Years ago, after my divorce, I was broke. Really broke. I was stuck
with $20K debt that wasn't mine (it was his) and struggling. Then one
day, I arrived home from work (via the bus) to discover that I had
left my keys at work. I had a dog with some digestive issues at the
time, and I needed in the house ASAP in order to take her outside.
Taking the next bus back downtown, going to the office, getting my
keys, and then taking the next bus home ... well, I probably would
have been dealing with quite a mess by the time I got into the house.

I called a locksmith from the neighbor's house. It was going to cost
me $80. $80 I didn't have. As I stood on my enclosed front porch
with the locksmith, debating as to whether I thought my bank card
would go through for this guy, I thought, "Hey, I'm hot, he's cute, I
could offer... and not get stuck with $80 and potentially NSF hits as
well...." I mean, heck, I was married to an alcoholic, I'd sure done
it with someone very undesirable and for nothing in return. At least
this way, I would get into my locked house.

But for some reason, I just felt like I was worth more than $80.
Maybe if it would have cost $200 to get me into my house....

What if when the man talked about "other ways" to pay, he was
referring to getting you signed up for a Sear credit card??

I recently had over $700 worth of work done at Firestone and when I
mentioned to the sales rep I had taken cash from my savings account to
pay, he said, there were other options, A Firestone card being one of
those options.

Personally, if what you are saying happened to me, the LAST thing I
would do would be post it in this manner. I would find an attorney
post haste. I would think an attorney would take the case on
contingency.

I find it interesting that you're complaining about this but you sent
it as a COMPLIMENT.

I lost all sympathy when you restricted listening to the recording to
African-American women only. All women can be victims of this type of
solicitation just as all children, not just African American can be
victims of abuse. You should speak for all!

Also, when someone tells me there's another way besides cash to pay,
I'm thinking more along the lines of debit/plastic.

This video gave me a headache...

Any lawyers correct me if I'm mistaken, but is posting this on a
public board really the best way to go about a lawsuit?

Yup, I see this form of communication as very effective. Generic,
wide-ranging threats with the race card thrown in for good measure.

Sadly, the link has been removed. How disappointing, because I so
want to know how auto repair, race and sexual solicitation fit
together. Ah, what might have been.

Although I am not an african american woman, I was still interested in
hearing this exchange. I agree that if this happened, it shouldn't
have. I went to your site and read your statement. Then I hit play
and read your statement again as it scrolled through the screen - this
time along with some music to further dramatize it. Then I gave up.

If this is true, they should refund you any expenses that you are out.
They should probably go a bit above and beyond, but I don't agree
that they should settle for 3,000. Is there a reason to suspect that
Sears condoned this behavior? Is it possible that they have in some
way acted on the info that you gave them? IMO, an employee behaved
badly - very badly, you reported it (as you should). I see no reason
for this to turn into a payday for you. Sorry.

Ok, I give...went to the web addess you put in your letter...all I see
is another story apparently written by you explainong what happened
but I cannot seem to be able to locate the video that you keep saying
is there showing that sex was solicited by the Sears employee.

Somethng is just not right about this whole accusation.
First, you are willing to settle a sexual solicitation suit for just
$3,000.
Second you are playing the race card.
Third you never went to the authorities or filed a police report -
unless I am just not seeing this too.
You could have gotten a copy of the police report and placed it on
YouTube also.

So apparently the reason Sears doesn't believe this is because of the
above three reasons - the amount of money and the race card and no
police report.
Had you aksed for a larger sum of money then maybe they would have
taken notice...but $3,000 which may seem a lot to you is nothing if it
is a true sexual solicitation charge.

Sorry but if they did not repair your vehicle to what it should be
then you should be calling the BBB and other such agencies to try to
help you in this.

...of this being a video showing the evidence. The evidence is a
sound recording, which is only available for black women to hear.

I don't know if this particular case is true or not, but I have no
trouble believing that this sort of thing happens every day.

I do have a hard time believing that Sears' General Counsel said that
she won't do anything further (other than apologize, which does seem
to have happened) specifically because the victim was black. Not that
this sort of thing, too, doesn't happen every day. But I cannot
Sears' lawyer ever being foolish enough, particularly when talking to
someone that records conversations, that race was the reason that
nothing further would be done.
