Spring Park Apartments Charges Too Much for Cleanup

Posted Mon February 9, 2009 12:00 pm, by Tracy P. written to Spring Park Apartments

I moved out of these apartments approximately 1.5-2 years ago and just now received a mailed letter that I owe them $359 for apartment clean-up fees. This is on top of the $115 deposit that they applied to this debt. After asking them for a breakdown, they told me electric disconnect is charged to every customer that moves out and I did not turn in my keys which is $50. I'm ok with the key charge and neutral on the $16 for electric disconnect, but I could swallow those charges ok. But I DO have a problem with the $408 charge for apartment cleanup. I figured there would be a charge for apartment cleanup but WOW, $408 for a one bedroom. I offered them $200 to settle and the best they could do was give me a $50 discount. If you look up there reviews on Yahoo they get a horrible score.

I offered them what I think was a fair amount of $200. With the economy the way it is, I think this is more than fair. I would like for them to settle at the $200 amount. They have already kept my $115 deposit so this would give them a total of $$315.

I don't think they can come after you for these fees. It's been a
long time since I was kneedeep in landlord/tenant law, but I am
finding it difficult to believe they have recourse at this late date.

Of course, you'd not have to pay any clean-up fees (generally--many
landlords are evil bastages about this stuff and suck big time) if you
clean your apartment properly when you move out.

I was almost with you, but then you pulled the "with the economy the
way it is" line.

What does the economy have to do with it?

All I can say is check you lease to see if it specifies how much the
cleaning fee is, what the timeframes for being charged are (2 years
later is ridiculous), and what the requirements for check-out were.

I've rented several apartments in my life and have been charged these
fees, not because I left my apartment dirty, but because they charge
each resident the cost of painting, cleaning appliances, and carpet
cleaning. It's a fixed amount to restore the place to move-in
quality. If there is damage, yes, there are additional costs.

Your argument shouldn't be with the economy or what you think is fair.
It should be that they waited several years to bill you. At this
point, it's on them to show that you left the apartment in a condition
that required excess cleaning.

Unless, that is, your lease specified a higher fee.

Most states have laws in which they only have within 30 days after you
leave to send you a bill, or they can't bill you later. Check up on
your state laws if they sent you a bill later than that.

This was most likely included in the contract you signed upon leasing
your apartment, therefore you agreed to it. Sorry, but you are out of
luck.

If you clean real well before you leave, you get to pay zero for clean
up fees. Now if you damage the apt, that is a different fee.

Good Day
