A $32.00 late fee issue out of control

Posted Sat July 11, 2009 1:13 pm, by Ricky B. written to Wells Fargo

Write a Letter to this Company  |  Rate this Company

I have a account with Wells Fargo Financial Cash On Demand. I paid the wrong Wells Fargo account and was charged a late fee. I wrote a nice letter including supporting documentation to the Address listed. All I asked was that the late fee be removed and negative effect on my credit account be removed. I paid the amount due on the account minus the late fee (Minus the late fee). Next month I get a late fee again. I always pay on time and over on all my accounts. So I started getting calls on a $32.00 late fee. Your folks at 5153319485 tell me I owe it. So last month I paid it then was so upset called back to the main number the individual said no I didn't owe it and removed the charge. Now here we are again this month. Talked to a supervisor who said the "Late Charge was removed" but not the associate fee because of FDIC rules. This is the first time I have heard that line. Then to make matters worse your going to raise my interest rate supposedly because of late payments. So as of now I still owe $32.00 and getting my interest rate increased only on that particular account. Up till this incident I thought Wells Fargo was the best, that has drastically changed.

I also have a mortgage with you and how would I in good faith renegotiate a mortgage like I keep getting asked if I am treated like this.

What I would like is the $32.00 to be removed completely. It was a late payment fee !! Or credit it to my principle and I will pay it.

Don't increase my interest rate on the card since this is triggering it since none of my other rates have changed.

Again I sincerely wish to thank everyone who has voiced their opinion.
I just want everyone to know I went ahead and paid the "Late Fee".
This squarely puts the ball in Wells Fargo court, and it is not so
much about the money it is the principle. Were back to being the
little guy not that much changed during the bailout. Thanks again

It seems the bailout was good for one thing... by dulynoted (aka duttycalls) Tue July 14, 2009 @ 3:56 PM

While I agree that they are going a little overboard on the phone
calls I would pay this then dispute it futher. As it stands now its
running negative on your credit and will not help if you do decide to
renegotiate a mortgage.
Just make sure you record every calls regarding Wells Fargo if
possible and keep all email/other correspondence.

Fighting a battle is fine but sometimes you have to step back, regroup
and find another route.

On the one hand, the error WAS yours and they rightfully charged you
the fee. They didn't OWE you a reversal on this. But what seems over
the top is the constant harassing phone calls over $32! Surely the
staff they are employing to call you has to cost them more than the
piddly amount they want to collect.

Realistically, one late payment, less than 30 days overdue will not
make that significant a dent in your credit if the rest of your
history has been clean. But banks today are incredibly stringent
because of all the people whose negative credit skyrocketed out of
control over the past few years. Even the smallest infraction is
going to cause them to crack down on you. It may be after the fact,
but at least you know now to be extra careful with all your accounts
going forward.

I would do the best you can to pay off this card altogether and then
close it out or try transferring the balance to a card with another
bank that maybe won't be so punitive.

I'm torn on this one. by Binkster Sun July 12, 2009 @ 9:34 PM

After talking with the Supervisor at the 515-331-9485 which is WF's
Collection Agency, and coming to no agreement. I got no further calls
for the rest of the day. This morning (Sunday) different story I am
being called so far three (3) times a hour over a 32.00 fee. If I was
behind a couple of payments, and something else I failed to mention
earlier when they remove the late fee, the calls stop. So being told
that the two are not the same is Bull, and I have through the years
considered myself a good Wells Fargo customer, I have always paid on
time and over the amount required, but this has really left a bad
taste in my mouth. And sure I made the mistake but I wrote them and
showed them where I made the mistake they removed the late fee, and I
paid the balance due. The late fee was and has been removed from my
statement multiple times. But the next statement it is added back on.
If they had told me no you need to pay it then it would have been
paid. I would not be going through this. I just want to thank everyone
who has read this whether you agree or disagree.

If I understand your letter correctly, I think the mistake you made
from the beginning was paying the bill minus the late fee before
receiving confirmation that the fee was removed. You can't just
assume they removed the fee deduct it from your bill simply because
you sent them a letter. It doesn't work that way, and I think that's
where the confusion began.

I am curious about one thing. Are you saying the bank keeps asking
you to renegotiate your mortgage? Are they offering you a better
deal? That's interesting.

Nate your missing the point Wells Fargo said they would no charge me
the late fee and have taken it away (3) times. However and what
everyone needs to be aware of is that even though they removed the
late fee they are still charging me the late fee amount. So you can
explain that one.

Secondly I paid then the amount that was owed, and if they had said
well you screwed up and you owe the late fee that would have been fine
too. But they took away my late fee.

Oh and one other thing I do pay my bills properly and on time, besides
where does that make them right telling me one thing and doing
something else.

One person mentioned that it could be removed, however it seems that
this was not the case. Maybe they made a mistake, just like you made
in not paying your bill on time. You had good faith, so did the first
rep. But we all mess up.
" I do pay my bills properly and on time"
No you obviously don't if you were assessed a late fee.
"you screwed up and you owe the late fee that would have been fine
too. " You admitted to screwing up right there.

Sure it is strange that they said they would and another person say
no, but it's their word over yours, and like I said, they likely made
a mistake.
