PAYPAL trying to bully and collect on debts that are not mine

Posted Mon February 1, 2010 12:00 pm, by BROOK O. written to PayPal.com

Write a Letter to this Company

Friday, 01/29/10, I received 7 individual collections notices from ERSolutions on behalf of Paypal referring to over $2500 in debts that they wanted me to pay. I have a Paypal account (or had) and they somehow think I owe them this money. My first response to Dennisha (Executive Offices of Paypal) was that I would like to file a ID theft and fraud affidavit to launch an investigation as I never opened these 2 accounts that they mentioned and never agreed to or incurred any negative charges. My paypal balance is at postive $44.52 but now restricted since the have falsely connected my good account to 2 bad account over 8.5 years old. Dennisha and 4 others, Marla in collections, Kelly in limitations, Sage in collections and his boss Rob all told me that it was my word against theirs and that someone else entering my SSN for account validation in a state that I did not live in when these were opened, causes me and my family to be fully responsible for paying over $2500 in their company's losses. I DO NOT THINK SO! Dennisha made mention several times that she did "not care" about my case. She even wimpered in a mean tone to me on speakerphone, so my partner could hear also.
Paypal told us that we have to do all the work to clear my name and that they will not help a victim of fraud or ID theft. They will not even send me a fraud affidavit to fill out. They are threatening to place 7 collection on my spot less credit history now even though they admit the deliquency on the other "ghost" account is over 8.5 years old. By FCRA law and statues of reporting limitations by creditors and collection companies they cannot put these on my reports. I am a victim and I want these unfair treatments to stop and for them to actually look into my case. I WILL NOT take money from my family to pay for their computer screw up. Apparently anyone can get someone else's SSN, enter it using an anonymous email account (both used here) and that make the person with the stolen SSN responsible. I am writing the White House and contacting ABC world News, NBC News and ABC to shre my story. I see that others have had this happen to them also. We need to ight back. Please help. I am a good citizen that pays on time and values my Christian beliefs. Please help myself and my family.

Actually investigate and find that these are NOT my accounts. Also go away and stop harassing us for debts that are not ours. We have perfect credit historys that we will fight for and sue PAYPAL and ERsolutions Collections for if this comes to blows. IMMEDIATE ACTION IS REQUIRED!

PAYPAL is backpeddling. They responded to the CA attorney general
with little to any info expect to contradict the amounts and provide
no proof that I had opened these accounts. The alleged negative
account that they want to clam are mine are from over 9 years ago. I
was more than happy to let them know that 9 year old deliquent account
cannot be placed on credit reports and that if they ever tried, they
would be paying me compensation in court. They think I am playing,
but I have successfully sued companies over the years that downplayed
my tactics and they now feel the burn of what I can and WILL do.
Paypal is known for limiting good accounts and trying to connect them
to other nagtive accounts to collect money that they would otherwise
loose. ER Solution manager, Debra, told me that all Paypal can do is
send letters BUT that I was 100% correct in my FDPCA and FCRA law
quotations that ER solutions or Paypal can NOT place any negative
information concerning these account on my credit file since the
statues of limitations is past the CRA 7 year reporting rule. All
either can do is send me letters hoping I will pony up money I do not
owe. I have also been reviewing cases against Paypal and complaints
against them filed through forums and with the CA attorney general's
office. NOT once in any case has Paypal succesfully been able to plce
any aged info on a credit report. They are known to try and collect,
which by law they can indefinately, but they cannot report. I spoke
to some VPs from California last week. They tried settling for less
that $400 on both alleged negative accounts they say are linked to me.
I am sticking to my guns and asying no to a company that promotes
FRAUD and IDENTITY THEFT. I also found out that Paypal's tactic for
account review are being investigated by governmental agaencies for
violations of the Homeland Security Act. Proper picture IDs were
never used to identify me when opening and verifying any acounts. A
nice call and form letter to the White House helped me with that
(Consumer Affairs Division). I am winning and will continue to fight
them and any other corrupt company.

As for it being a fraud, I'm not so sure. Paypal is know for doing
crazy stuff like this. I had my own problem with a camera I sold on
ebay. This was about 2 years ago. I shipped it, thought everything was
ok, kept my receipt saying I shipped "something". Guy says he didn't
get it and disputes it. Paypal automatically sides with the buyer
unless you did delivery confirmation which I didn't (learned my
lesson). So not only was I out the camera, but they obviously took the
money right out of my account too. But paypal should be up front and
say "you will automatically lose if you don't use delivery
confirmation". Or simply state that delivery confirmation is a
requirment. Nonetheless, I learned my lesson. But others have had much
more bold things happen to them. There is a website called paypal
sucks or something similar with all kinds of horror stories about
accounts being frozen...for thousands of dollars and not being
released until 3+month investigations are completed...which can really
mess you up. And just in case anyone is actually reading this far,
remember to NEVER keep a balance with paypal. That's really the only
way to protect yourself. Yes, it will go into a negative balance and
yes it could be reported to collections but at least you wouldn't be
out the money.

this is important because...

if it's via snail mail it's worth looking into.

if this is via email then it's a hoax.

For example I've received notices that my account was locked due to
illegal activity and that I was barred from using it until I logged in
to the link they provided & verified it was me. I was also banned
from making new accounts.

BUT I knew they were lying. The notice had been sent to an email
address that wasn't associated with my paypal account.

I just opened a new PayPal account this weekend and at NO POINT was I
ever asked for my SSN - just bank account and credit card info.

It almost sounds like someone is trying to con you into paying by
placing a complaint against your account and then demanding money from
you.

I would seek legal advice QUICK before this goes any further.
