did you go back to ask them for it?

If it's been over a day it will probably be too late I'm afraid.

You can ask, but if it's been over 24 hours there's going to be no way
to verify that you didn't receive the food you paid for.

You can still ask, I mean but... if they say "no" ... there won't be
much you can do.

Did you happen to notice this before driving off? If you were still at
the window, you could have asked politely, "I ordered a frosty and did
not receive it." I'm sure they would have gladly given it to you since
you had not received it.

This is an issue that can easily be rectified by the store. As soon as
you noticed it was missing, you should have gone back or at least
called an informed them of the issue. It likely was set aside that
they simply overlooked it. After you left, they might have noticed it
and wondered why you never came back.

When I worked at Wendy's, the manager had a board of people who we
owed food to.

I agree with Nathan. How did you not notice the frosty was missing.
Usually they give you that separately but even if not, the bad would
have been much lighter.

Yes, you should get what you paid for but something like a drink is
easily noticeable.

Are not a drink, but a dessert. It is like a cross between a milkshake
and soft serve.

I used to work at Wendy's, and the proper procedure for delivering a
frosty at the drive through was to put a lid on it, and put it in a
bag along with a spoon and napkin. This is a strange procedure in my
mind, and not many stores actually do this. In the instance that this
specific location follows this procedure, and the OP regularly orders
this, he may have expected it to be in one of the bags.
