Rain checks at Von's in California

Back in 2009 I was invited to a grand opening of a Market store in Belmont Shores. I was enticed by the offer of one liter Evian waters for $1 and Vueve Cliquot champagne for $31.48 after tax. I went to the store and was told they didn't have any Evians or Vueve Cliquot and offered me rain checks. I have been trying to use these rain checks ever since. I was given a rain check for 100 bottles of Evian and 25 bottles fo Vueve Cliquot. I was told I could go to any Vons or Pavillions or Market and purchase these. I live in ------, so I went to my local Pavillions and was first told "we are not a warehouse store" and we can not sell you that many. I was then advised to return at an conveyant time; mid week before 5pm. So, I took time off from work to go to the store and spoke with the manager who said they would order it for me. I was told they would call when my order was in. They never called. I went back to the store about a month later and was told the store had a new manager. She requested I bring her my rain check. I returned a few weeks later with my rain check. She said she would research to see if an order was placed. As they do not carry more than a few Evians or Vueve at any one time. She assured me she would call. She never did. I returned again and was told there was yet another manager and she requested I give her my rain check for the Evian and she would place the order and call me when they arrive. Now she had my rain check, my contact info and assured me in a promise that she would take personal responsibility for this order. I never heard from her and she no longer works at the store. I have gone back in twice more requesting my rain check returned to me and for someone to see about my order. I am now told there is no record my order or my rain check and they can not accommodate such an order for that offer as it would be at a lose to the store.
I thought here in California we had laws to protect consumers from switch and bait and false advertising, thus creating the rain check policy. However, your store doesn't seem to follow these same consumer guidelines and laws.

I would like to place an order for 100 waters for $1 each and 25 bottles of Vueve Cliquot champagne for $31.49 each.

Now that right there is another interesting issue.


I'm not sure how you expect them to fix it. She has the data. If she
dropped the ball before quitting or being fired... how do you propose
they get the data back from her? They can't. I mean they can ask
but she can tell them to 'die in a fire' if she wants. ain't any way
they can force her to comply on that one.

I swear every time I see "bait and switch" I hear Inigo Montoya's
voice saying... "You keep using that word. I do not think it means
what you think it means."

Running out of stock is NOT bait-and-switch. it happens. stores do
not have a TARDIS to provide infinite storage.


And frankly I'm rather surprised anyone gave out a 100-count raincheck
for anything.

Plus it's a bit ironic really. You're claiming bait-and-switch
because they dared run out... what do you think the 100-count order is
going to do to the stock?

And what will you do if say... the customer ahead of you buys up
everything first? Is it then still OK to sell that much to a single
customer?

If you are worried about California Laws, why are you writing Safeway
Canada?

I know in my state, rainchecks on liquor are a BIG no no....Store
policy also gives us a limit on raincheck quantities and 100 or 25 of
anything is way beyond that limit. Sounds like someone screwed up
writing the raincheck, especially for those amounts, and no one wants
to admit it.

Now you don't even have the raincheck because you handed them over and
left... You may be out of luck here.
