DEMAND FOR RETURN OF MY DEPOSITED FUNDS!
Posted Sun June 17, 2012 4:39 pm, by Sherry M. written to JPMorgan Chase Bank, N.A.
Dear Sir or Madam,
I allege mail fraud, conversion, fraud, misrepresentation, and defamation by JPMorgan Chase Bank, N.A., (hereinafter “Chase”).
On or about June 2012, Chase mailed an advertisement to me that promoted a $125 bonus for opening a new checking account.
On June 11, 2012, I applied online at Chase.com for a "Chase Total Checking Account" at which time I deposited $25 to the account number [DELETED] using my Visa debit card; I entered the promo coupon code number [DELETED] for the $125 bonus.
On June 15, 2012, I called Chase to arrange direct deposit to my new account and, to my dismay, was told by Chase representatives the account was closed (without my prior notification or consent).
I asked Chase representatives the reason why my account was closed and was provided no reason. In addition, I demanded that Chase refund my $25 deposit back to me – I have yet to receive a refund of my deposited funds.
On June 16, 2012, I visited Chase (Carmel branch) to attempt to resolve any questions or concerns about opening the account. I presented my driver’s license and social security number and was told by the branch manager that my account was closed -she provided no reason.
In anticipation of opening the new account, I had also closed out the account with my former bank.
Chase’s alleged fraudulent actions have caused me including, but not limited to - mental and emotional anguish, severe distress, tortious interference with credit expectancy, loss of time and money, and inconvenience.
I also allege that Chase’s wrongful actions have also posed undue burden on my former bank for having to close, then reopen my account.
I allege Chase has violated multiple federal and state laws.
First, Chase did not honor the $125 promotion they mailed to me. Chase, allegedly, committed mail fraud, misrepresentation and false advertising. I shall also file a complaint with the United States Postal Service for Chase’s alleged mail fraud.
Second, Chase accepted my deposited funds (legal consideration, quid pro quo), thereby, establishing a banking relationship.
I allege Chase, apparently had no “good faith” intent of establishing a banking relationship as so proven by Chase’s actions to fraudulently deposit and convert my funds, then close my account, and never return my deposited funds. Chase’s actions constitute conversion and fraud.
Third, Chase, allegedly, fraudulently accepted my personal identifying information (social security number, driver’s license information and other personal and confidential information), with no intent of establishing a banking relationship.
I previously had a mortgage serviced through Chase. I was a victim of illegal foreclosure and embezzlement by my homeowners association, FBI and IRS are currently investigating several Nevada homeowners associations for fraud. http://www.justice.gov/opa/pr/2012/June/12-crm-701.html
If Chase discriminates, defames and/or tortiously interferes with my credit expectancy as a result of being a victim of fraud, I shall take all appropriate legal actions against Chase and its agents to the fullest extent of the law.
Based on the foregoing allegations, I demand that Chase provide the reason for the account closure and immediately refund (via wire transfer) my deposited funds that were converted by Chase.

Lots of legalese there. I had to laugh just a little when you included "inconvience" after what seems to me to be much more serious issues.
You do have to follow the terms and conditions on any offer, and it does seem as though you failed to. I get these offers in the mail a lot, and there are minimum deposits as others have noted. And as far as I know, Chase may turn down a customer if they choose.
Do you really think they sent you this mass-mailed ad with the intent of defrauding you?
Further, Chase is not responsible for the fact you closed an account at another bank. That was your decision, and you bear all the responsibility for it.
Really, all I see Chase owes you is your orginal $25.00 back. And it may take more then a couple of days.

The key here is to be patient.
I have read on the interent that assertive people do not demand, but aggressive people do.
Exactly where do you get your proof that you allege mail fraud, conversion, fraud, misrepresentation, and defamation by JPMorgan Chase Bank, N.A., (hereinafter “Chase”)?

We receive these ads on a regular basis. One of the terms is that the $125 will be deposited after a certain number of months. I'm thinking maybe 6.
And six days is pretty quick for you to decide that Chase will "never return" your funds. I'm betting you'll receive a letter in the mail explaining their decision.

Those promotions are typically for new accounts/customers only. You stated you held a mortgage though that bank, my guess is that is the reason it was denied.

Sounds like you applied for the account, but were not approved. Since you applied online (not in person), I would expect the confirmation or denial of your account status to be communicated to you via snail mail. Since your deposit of $25 was via debit card, I would also expect the refund of this to be made via check sent via snail mail.
You have not been defrauded or defamed. I think you were simply not approved.
As you've shared that you had a mortgage that was foreclosed on (through this same bank!!!), I'm surprised you would expect them to welcome your business now. Foreclosure certainly sounds like grounds to deny any further banking relationship.
