WORST TRIP EVER!

To whom it may concern,
I was a guest at your hotel at the end of October, 2011. I was there with my husband, 2 children and my mother and father in law. My inlaws had not been to Disneyland in about 20 years, and it was the first trip we had taken with them to be able to have them see our kids in Disneyland. We arrived at your hotel and my mother in law fell in your front walkway. The coloring of the curb that matched the color of the driveway made her mis-step and fall really hard. We went inside and completed check in, with her in tears the whole time. The staff didn't care, and only offered to even have her fill out an incident report after we had asked to do so. Within about 15 minutes, her knee was so swollen she could not bend it. We again confronted the staff who just said they were sorry. They never offered to call an ambulance, they never offered for her to see a doctor. That night, no one slept as we had to help her up and down and even to go to the bathroom or get a drink. The next morning her entire leg from mid shin to thigh was black and blue. Again, we showed the staff who took pictures, and again blew us off. We went to Disneyland with my mother in law using the wheel chair we had brought for her husband. My husband and I spent the day at Disneyland pushing 2 people in wheelchairs, assisting them to go to the bathroom, and not sleeping as she was so miserable at night. The next morning, after asking the staff to let them move to a handicapped room so that they could at least let her use the wheelchair in the room (they were denied), they decided that as miserable as they were, they were going to just head home. I have pictures and video of the place she fell and her leg at various times while it blackened and bruised. They paid hundreds, even thousands of dollars for all of us to go to Disneyland, including rental cars, hotels, Disneyland tickets, food, gas, etc only to have the entire trip ruined. Worse still, once she got home and got her medical worked out with Medicare, my mother in law found out that her awful looking leg was the least of her worries. She had gotten a fracture in her spine when she fell. She has been in physical therapy for almost 5 months now, attempting to repair the damage. I wrote an email trying to discuss this, and never got a response. I changed to his hotel from the one I usually use, and BOY do I regret it. The staff was cold and rude. They didn't care what kind of pain she was in, and they certainly didn't care that she and her husband left a day early from their trip due to this injury. This was a special trip for us, and it was thoroughly ruined.
I would like at the very least, a handwritten apology. At best, I would like recompense for the ruined trip and my mother-in-laws injuries. I have encouraged them to get a lawyer and sue, but they are the least confrontational people I have ever met. They do not want to have to travel to southern California every again in their lives....and that is all thanks to the "wonderful" service we were given.

Apparently you didn't feel it was necessary to take her to the hospital...if you took her to DISNEYLAND the next day. Wow.

I used to work in retail. My store had bicycles set up in the sporting goodds dept. for guests to look at and buy off the shelf, if they so desired. They are up off the floor and in holsters to prevent them from being moved easily. I'm pretty sure there were signs (even back then) that stated guests should ASK FOR ASSISTANCE before removing bikes.
One lady was not content to just LOOK at the bikes and decided she needed to "try it out" - while standing in the rather narrow aisle!!
Naturally, as is dictated by Murphy's law, the guest fell while trying to get ON the bike to see if the fit was comfortable. She twisted her ankle on the way down and an ambulance was called.
Was it the store's fault for displaying bikes for purchase? Nope! Did anyone FORCE the guest to pull it off the rack and try to hop on and take it for a spin - no way!
I SUPPOSE there COULD have been a sign posted warning folks NOT to try and get on and ride the bikes around the store, but seriously, WHO DOES THAT?
The fact that your MIL tripped and fell walking up a curb (and again, where were you to help her if she was so unsteady?) that no one else in your party had an issue negotiating is NOT the fault of the park. It's the fault of her caretakers.

Obviously it doesn't take a rocket scientist to see she needs to call an ambulance. Its not their mother n law so it should've been upon you or your husband to call the ambulance. This is all your fault because if she was that hurt the first night she would've been dropped off at the hospital in the first place. Instead you still decided to go to Disneyland anyway(how stupid) thus keeping this woman in dire pain. Omg honestly she should've been your main priority not Disneyland forget that this lady is in pain Hospital duh. The only inconvenience that the hotel should've done was make sure that nobody else made that same mistake. I'm sorry but this could've been prevented

Wow - so much wrong here. How can you be mad at the staff for not calling for medical help when you didn't? I can't imagine letting any have a knee that swollen, and that much pain and bruising not seek medical help. MUCH more important than any vacation.
They did file a report. They took pictures to document the injury. Why is it more their responsibility to get her help than yours?

I agree, the fault lies on ALL (adults) of you. I feel bad for your MIL because you and everyone else felt that Disneyland (and her money) was more important than the health and well being of your MIL. What was stopping YOU (or anyone else) from calling an ambulance?? Although it is hard to say where she got the fracture in her spine from, it may have been spotted if you would have taken her to the hospital and had X-rays taken. Elderly bones are a lot more fragile than younger people and it doesn't take much to damage them, and would have possibly not needed to go through so much PT (and pain) had you taken her to the hospital sooner.

This is all on you.
You didn't get her to a doctor after it happened.
You drug her to Disney Land anyways.
I know it sucks to spend a lot of money on a ruined vacation, but the hotel staff didn't ruin it.
I hope your MIL gets better.

While you have pictures that show an injury to her leg, you don't have any proof at all that the spinal injury happened in the same fall. You went to Disney. Unless you have a video diary of every step along the way at the park, the lawyers would have a field day suggesting that something you guys did during the day at the park caused the injury or caused it to be worse. It's a sad fact that the world is run by lawyers, but the world is run by lawyers. Hope you MIL gets completely better very soon. Legally, though, I doubt you're going to get any response out of the property.

Why are you expecting the hotel staff to care more about your MIL than the rest of the family did?
None of this is the fault of the hotel or hotel staff. NONE OF IT. One woman wasn't watching where she was stepping and fell, and then she and her family decided it wasn't worth seeking medical treatment.
This is all on her own darn self.

The problem - or rather problems - you're going to face with this are going to be...
1) It's now almost NINE MONTHS after the accident. This late in the game you're going to have a hell of a time proving that this fall happened on their property.
2) You publicly stated that the hotel should have called for an ambulance yet YOUR FAMILY never got her medical until AFTER your vacation was over.
So... which was it? You can't have it both ways. You can't accuse them of not responding to an emergency - not when you yourself didn't respond either.
3) And now you want them to apologize in writing. That sure as hell won't happen because their lawyers will not let it happen.
They're not stupid. They know if they apologize to you - in writing nonetheless - you can take that letter to court and sock them for all of the medical bills, claiming it to be proof that they're responsible for it.
Nice try but it ain't gonna work.
So now we're back to the main issue - if the guest themselves won't even call 911, why is someone else suppose to assume responsibility for this?

You go on and on about how the hotel didn't call the ambulance or care about your MIL injuries and then you drag her to Disneyland instead of taking her to have it checked out! I just can't get over that...

The hotel staff might have inquired if the mother-in-law wanted to go to the hospital.
Perhaps the family could have taken the mother-in-law to the hospital instead of checking into the hotel and going to Disneyland.
If I was the mother-in-law, I would have insisted on getting medical attention first instead of checking into the hotel.
So yeah I feel the entire situation could have been handled better between both parties.

I understand that the stay at the hotel at Disneyland that you, your family, & your mother-in-law stayed at was not a good one, but I do feel that you should have taken your mother-in-law to the emergency room once she had the accident instead of checking in. Why did you not get the much needed help for your mother-in-law after she fell? Why did you decide to stay at the hotel and go to Disneyland after her accident? I understand that you wanted her to see Disneyland, but she was in obvious pain after the fall. Could she have not received a refund or have been given vouchers for all of you to return at a later date?
The staff apologized for what happened. They did not blow you off. They offered an incident report. They did what they could based on hotel policy. As a previous poster mentioned, the hotel wants to avoid a lawsuit.
I am curious as to why you want compensation for your mother-in-laws injuries.
You do realize that if your mother-in-law got a lawyer, she would have to pay for the fees even if the lawyer tells her that she has no case? Plus there is no guarantee that the lawyer would have taken the case.

What you saw as "cold and rude" was actually the staff avoiding a lawsuit.
One of you could have taken the kids and father-in-law to Disney, while the other made sure your mother-in-law sought proper medical treatment. Not the vacation you'd envisioned, to be sure, but neither was the vacation you actually got.
In addition, prompt medical attention could have saved your mother-in-law from a "hidden" spinal fracture and months of pain and PT.

Having worked in retail management we were taught to never say sorry or admit responsibility. It was okay to call for an ambulance if the injured person asked but we could not volunteer to call one. All we were instructed to do was fill out an incident report and view the area the incident allegedly happened.
I don't understand why the OP didn't take her mother in-law to the hospital if she was injured that badly. If I or anyone who was with me got hurt like that we would go see a doctor, not continue to go to Disneyland.
