Follow up regarding Dockers/JC Penny Free Flight Voucher offer....

This letter is a follow-up to my original letter written yesterday, to provide some additional information to your corporate staff. I am referencing the Dockers/JC Penny free flight promotion - purchasing Dockers products to get a free flight voucher.
Executives of JCPenny...are you aware that the company, TLC Marketing in Boston, MA that is in charge of your promotion and dealing with your customers has had 378 complaints to the Better Business Bureau of Boston in the last 36 months? This information is easily accessed by the internet.
I would have thought your marketing staff would have better evaluated the company who is in charge of this promotion. I have always been a regular and loyal customer of JCPenny. It is too bad TLC Marketing is giving you a black eye by their method of administering this free voucher program. Just thought I'd pass this information along.
I would like to see more pressure on TLC Marketing to step up and deliver what they promised in writing to the consumer. There are pages and pages of complaints on the internet about this company and about this offer. Simply google "TLC Marketing Dockers Free Flight" and you will have plenty of reading material.

This was a real scam...I have made several attempts to contact TLC because I did not hear from anyone regarding my booking requests. I was told on numerous occasions that someone would be contacting me to confirm my booking at least 2 weeks prior to my date requests. When all of my requested dates passed I still had not heard from anyone so I phoned and chose new booking dates; at this time I was told all flights had to be booked by 7-31-08 and that I would definetly hear from someone by that date. On 7-30-08 I still had not been contacted so I phoned to get I very unhelpful customer service rep who told me the company would contact me by tomorrow; I asked for her supervisor and was told there was no supervisor at the location. Low and behold no one contacted me and when I tried the phone number today (8-4-08) there is a recording stating the promotion has ended. Shame on this marketing company & on Penny's for not supporting there customers w/this. I would definitely be interested ina class action suit! I think that folks should boycott Penny's as well until they offer support to customers w/resolving this. Demeter536@aol.com

I, too, am one who purchased the Dockers in good faith and have yet to have someone contact me as has been promised on numerous occasions over the past ten or eleven months.
Just this evening I was told by a rude Customer Service Representative that someone will contact me by July 21. I wonder of what year? I asked her what to do if they don't as I have received this same type of reply many times over. She said, "then write a letter to the company." You can bet that I will. The BBB in Boston will also be contacted by me.
Yes, if anyone starts a Class Action Lawsuit against all parties involved, I'm in. Please contact me at pmgens@hotmail.com.

Well well, I see I am not the only one screwed by this. I sent in my voucher in Mid-June, and only get the recording of "we'll contact you before July 3rd". Now what do we do? A class action suit sounds good, but we won't get anything until next year. I'd still like to get my flight voucher, although I probably won't get any of the flights I wanted, or destinations for that matter.
I think we should let JCPenny/Dockers know that shoppers will be boycotting their store and merchandise, as they should take some responsibility in this as well.

I will not be shopping at JC Penney any more-I spend about $1000 a year there.

I called again today and the message still says I should have been contacted by July 3. I have not been contacted. I called the TLC main company number and was forwarded to the travel dask, where I got a recorded message saying that they were closed for the Fourth of July holiday and would re-open at 9:00 am today. It was, however, past 10:30!
Both Dockers and JC Penney ought to be outraged that TLC has so botched this promotion and tarnished their reputation and standing with a loyal customer base.
I certainly see this ending in a class action suit where nobody ends up completely satisfied.

I am one of the victim. I sent out the filled voucher around late may 08 and I called TLC customer service at least 4 times and almost on weekly basis. First two times they told me that they are reviewing it. Third time when I insist, they told me that the dates are not available. I called them back immediately (same day, around 6/25) and gave then new dates. She told me they will get back to me shortly. Yesterday (7/2/08) I received a letter saying that the voucher filled incomplete and saying unfortunately the last date is 6/30. This outright cheating customers.I wouldn't have bought if I would have known about this company. I will file a complaint against JC Penny as well as TLC. Since I am paying money to JC Penny they should hold some responsibility. Some one should be filling class action suite on JC Penny and TLC Marketting.

I concur, that is, I too, like hundreds/perhaps thousands of consumers have experienced TLC and Docker's (and Penneys) failures to live up to the terms and conditons of the "free flight" offer. The hundreds of complaints filed against TLC with the Better Business Bureau (see online site for BBB of Eastern MA/Boston) are growing --- and the complaints go beyond the TLC/Docker's/Penney's flight offer to other TLC promotions vs. T. I recommend that people who have lived up to their end of the offer, but who have experienced TLC's/Docker's/Penney's faulure to provide the free flights (in addition to failing to respond to calls, faxes, e-mails, etc.), submit complaints to the Better Business Bureau (Eastern MA/Boston), the Consumer Protection Agency/Federal Trade Commission, and the MA Attorney General's Office. Civil redress and restitution needs to begin, and the appropriate government agencies (e.g., FTC/CPA) need to begin/acellerate criminal investigations into TLC's (and the businesses with whom they contract) failures to abide by the terms of their promotions, inadequate communications/failure to provide free flights to consumers who abided by the terms of the "promotion" ...
