Unprofessional, maliscious crime of neglect after damaging my personal property!!

On july 21 i purchased a skid of concrete from lowe's polaris ohio. As i stood and watched the man load my truck with the skid of concrete he slammed the forks into my tailgate not once but twice in front of 5 other people including 2 of my employees.. Another associate finally stopped him as all he could say was "oops sorry". The other witness (associate) went after a manager who came out and wrote up an incident report and took several pictures. The manager told me that i would receive a call from a representative within 48 hours. 1 week later after no correspondence i called lowes an a manager told me it was now out of their hands. It wasn't until august 19th almost a month later that i received a letter from crista mcnair, and it read like this, " AS YOU KNOW SRS IS ASSIGNED TO HANDLE THE ABOVE REFERENCED CLAIM ON BEHALF OF LOWES. WE HAVE BEEN UNABLE TO REACH YOU IN REGARDS TO THE INCIDENT AND IT IS NECESSARY TO SPEAK TO YOU TO CONTINUE THE CLAIM PROCESS. S he gave her name number and time she would be available. After sever weeks of calling and leaving messages she finally called me back. I told her what happened and she said she had pictures sent over from lowe's and she would close out the claim within 48 hours. On sept 8 she sent two emails asking for pictures so i sent them, then she requested another set of pictures with a claim #. On sept 12 2011 i received a letter " we have carefully considered your claim and based on the info to date it is our OPINION that our account would not be held responsible for this accident. I thought it was her job to look at the facts(pictures taken by a lowes manager) and not be judgmental enough to form an opinion. she carries two names as an alias and to me that is extremely shady but i guess it carries presidence for justifying her opinionated claims!

I want Lowe's to pay for a brand new tailgate and own up to the crime that was committed against me. This to me is no different than a hit and run. I should of called the cops and filed a report but i trusted the manager at lowes who told me they would have no problem replacing my tailgate. I would also encourage them to take another careful consideration as to who they are outsourcing these claims with. Her job is to not drag her feet and then use her opinion as a judgement call to help the company that she is representing blatantly screw someone over. I am a business owner and i WILL NEVER EVER STEP FOOT INTO ANOTHER LOWES DEPARTMENT STORE...EVER!!! This has got to be the most malicious, unprofessional sceme to screw someone over that i have ever seen! They should be a shamed of their selves. This is bush league professionalism! I hope that you are happy for the treatment that you gave me lowe's!!!! I have saved emails, letters that i have received from SRS and phone records to back up everything that i have said!

It appears you allowed the cement to be loaded in your truck by the
Lowes people. I would think they own partial responsibility. All the
best.

Negligence is NOT a malicious crime. By it's very definition, it's an
act of indifference and inattention. It's kind of hard to be
delberately careless.

As others have said, hand it off to your insurance and let them sort
it out! That's what they are there for.

Like Red said this is a matter for your insurance company to work out
with their insurance company.

As far as the associate using an "alias" my bet is she uses her maiden
name and her married name on different occasions. That is a non-issue
IMHO.

If our Lowe's was not 13 miles away I would drive over to refresh
myself on signage in their pickuo area that might elaborate on their
potential or limited liablity.

How about your contact your insurance company and let them fight this
battle for you? that's what you pay them to do.
