Fraudulent charge re-applyed

My card was stolen in Dec, 2005 the same day it was stolen a 392$ fraudulent charge was placed on my card. I called and reported the card stolen and disputed the fraudulent charge the very next day. MBNA said I wouldnt be help responsible for the fraudulent charge. A month later I get later stating the conducted an investigation and since the card was physically present at the time of the transaction I was responsible. EVEN THOUGH THE CARD WAS STOLEN! I find the results of investigation to be un-acceptable. Frankly, I find them ludicrous. Their response stated the charges are valid because the card was present for the transaction. Of course it was present, it was STOLEN! If they had checked their records they would have seen I reported the card stolen prior to disputing the fraudulent charges. So the fact the card was present really has no bearing on whether the charge is valid or not. I'm not supposed to be responsible for fraudulent charges made on a stolen card, correct?

Please credit my account 392.00 for the fraudulent charge.

Sounds like you are dealing with some real chuckleheads here. However,
I have to wonder about one thing. You don't mention filing a police
report and sending MBNA a copy of the report. Maybe you did this and
just don't mention it. However, if you didn't, then you unfortunately
will have a tough time distinguishing yourself from someone trying to
commit a fairly common scam, i.e., making a false claim of a stolen
credit card in hopes of being let off the hook for certain charges.
The filing of a police report is usually considered a sign of a
serious claim, as fraudsters are usually afraid to take this step.

Still the reason they give you for denying your claim is ridiculous.
