Misleading Advertisement by Office Depot

On Sat. Aug. 11, you ran a large ad in the Dallas Morning News for a one day sale, beginning at 8 am. Among the items listed for sale was a 22" widescreen LCD monitor with a $190 rebate. In the box there was a number along with the words "selection varies by location."

I went to the store at 8:15a.m.; selected and purchased a monitor and went on to run my errands. On Sunday evening, I sat down to complete the rebate form and saw that is was for $30 not $190.

On Monday after work, I returned to the store to find out what the problem was. The assistant store manager told me that there should have been a second rebate form. However, I had purchased the wrong monitor and the one that I had purchased was not eligible for the additional rebate.

No where in the ad, nor on the floor was any information indicating that only one monitor was eligible for the $190 rebate. When I saw the statement in the ad, I figured that 'selection varies by location' meant exactly that - whatever 22" monitors that had in stock at that location would be eligible for the rebate.

Since I was told that the monitor I had selected was not eligible, I simply returned it.

I would like for you to honor your ad and make the 22" monitor that I had selected eligible for the entire rebate. OR provide me with a $190 gift card toward the monitor of my choice.

I've been extremely unhappy about this since the day before I returned the monitor. I was unhappy about the $30 rebate form and everything associated with this purchase.

Office Depot doesn't owe you anything unless their ad specifically
said "$190 rebate off any 22" widescreen LCD monitor in the store".
You did not fully understand the promotion and didn't ask any
questions which resulted in your having to return the monitor.

For future reference, the phrase "selection varies by location"
usually means that only a few models of an item are available for the
advertised promotion and that all stores may not carry the same brands
and models.

Sorry you have been "extremely unhappy about this since the day before
I returned the monitor" is really not Office Depots fault and/or
problem.

Although the ad wording does seem a little bit misleading, it said
nowhere "Every 22" monitor eligible for rebate". I would have
certainly been asking questions. You didn't inquire about the rebate
while at the store, you didn't see any signs regarding the rebate, and
you didn't even check the rebate form you were given. I don't
honestly think they owe you anything. You need to be more proactive
next time in making sure that what you purchase is part of the sale.
I agree that letting them know the ad wasn't clear is appropriate, but
will most likely fall on deaf ears. That's how they bring people in,
by making them come in to get the details of the promotion.

To me selection varies by location means that not every store will
have the special deal monitor, but I could see where many people would
get misled.

I work for OD and can get confused myself.

As far as varies by location goes--that doesn't mean whatever 22"
monitor they have in stock. It means a certain one or two, whatever.

Yes, they should have had signs up. But since they didn't why didn't
you ask? That's all you had to do. You can't just assume that it's all
the 22" monitors.

I sure wish they had the sale here so that I'd know for sure just what
the wording was.

I think you wrote a great letter and have a valid complaint. It
certainly does sound like the ad was misleading and they should have
posted some signage at the store to spell everything out for
consumers. I hope you hear back from them!
