Complaint Description:
Washing machine purchased from Sears outlet store on 4500 NE 122nd Portland Oregong 97230 leaked water and ruined my floor resulting in $4100 in damages.
Washing machine was purchased at a Sears outlet store it was sold without support brace wich ultimatly jepardized washing machines internals. The machine was also covered with sears added insurance. to compound this issue the incompetant repair staff broke the machine two separate times while trying to repair it. finally 8 months later they gave up and replaced it.
this was a gruling event alone. 8 months of there service staff wasting out time. They make an appointment for 2 weeks away then want you to be there from 9 AM to 4 PM then they no show half the time. It was agonizing. however nothing compared to trying to resolve the damage to my house. 10 months later I have recieved nothing from Sears but wasted time headaches and stress. The Washing machine first had a minor issue it set a call for service code on its digital display. Weeks later the service guy shows up looks at it the parts are wrong. Washing machine worked with only an intermittant shut down in wash cycle. then at some point the machine leaked and ruined my floor.
Sometime months into the repairs of the machine there service guy does something and damages something else in the machine. This actually happened two times. he broke something else. At this point we have bought a replacement machine for it and the Sears repair guy continues to struggle with fixing it. this started in June of 2011 after breaking and replacing multiple things on it he tells me its fixed some time in late December.
So we hook it back up and it floods my house again for a second time. We drag everything out of the kitchen utility room and dry everything as well as possible. Cut open the vapor barrier and dry out the insulation under my houses floor. its now winter time and nothing dries easily in the northwest. in feb 2012 they gave up and replaced the washing machine at this point.
OK at this point Sears has been giving us nothing but greif as far as the claim to repair my flooring. When the machine first flooded my house Sears claims out of somewhere in Texas started a file on it and told us to get it fixed. They later ship us a form stating they encourage us to turn it over to our homeowners. But doing so will in the long run just come out of my own expenses.
The washing machine is an Electrolux and Sears placed the claim in there court. But after 9 months Electrolux finally stated they will not warrantee any isssues with an appliance sold at an outlet store. They also stated this washing machine had to be shipped and transported with a special support cradle for the drum. It was sold to me by Sears without this cradle.
The new replacement washing machine had this support cradle and its labelled in huge glowing writting that it must be used when transproting or moving this machine. And states do not throw away save for any moving or transport. Damage to machine will result. No cradle came with it.
Sears has there service and warrantee wrapped up in a manner you cannot talk to any one about anything. You dial in to an automated system that makes getting anything impossible. I am ready to take them to court over the issue but am looking for other options before proceeding.
Another factor when we bought the washer and dryer they were being sold as new unmatched set. As to why they are being sold in an outlet store. the salespeople are quick to sell you on these items come with the exact coverage as if they were brand new never been used and to top that off there added insurance program is so aggresssive in pushing there added insurance they start calling and calling months and months before your item is out of its warrantee and push the sales of it like mad. Then when you need it theres nothing no service no coverage nothing but 1 800 hope you got nothing but time to spare because we dont care
basically if Sears covers just the flooring repairs I will cash there check and move on. Theres still moulding to be replaced and a panel repaird behind the washing machine. The time I spent under the house ripping open vapor barriers and drying wet insulation Ill eat.
The countless hours myself or my family has waiting for ther incompetant repair guy to either stand us up or show up and break more stuff is lost.
Cover the cost to fix my floor and Im as good as I can be.

I find this helpful (having worked in management at Sears). First, if you already haven't contacted Sears HQ customer service in suburban Chicago, do that first. They will contact the store and pretty much demand they resolve it.
If not, file a claim in small claims court in the district you're in. Make sure to include as defendants everyone involved (repairman, Sears Corporate, Electrolux, and the manager of the outlet store and salesperson especially). They will each receive a summons to appear in court.
Show up in court with everything documented, and ask for all costs plus punitive damages to the max allowed. Make sure that after the summons have been served, you will work with them to settle out of court. If not, let them know that by dragging them out of their store to waste an entire day in a courtroom, you will have won either way since they will have been inconvenienced by the entire ordeal. Go to your local television station and invite them to come tape the proceedings (if allowed) or to investigate or try to rectify (like 9 on your side segments on TV news shows) on your behalf.
