$5.27 Refund Requested for Spoiled Subway Sandwich

On Wednesday, October 19, 2011 at approximately 7 pm, I ordered a 6-inch steak and cheese on wheat sandwich from Subway. The sandwich smelled spoiled. As a result, I requested a refund from a cashier named Muhammed. Muhammed denied the sandwich was spoiled and refused to provide a refund to me. Muhammed began yelling at me and told me that every day he serves "700 customers" and no one complains. Instead, he offered to substitute the spoiled sandwich for another sandwich. I refused his offer, because their food safety practices appear questionable. I asked the other associates for assistance, and they refused. I contacted the Chicago Police Department to intervene. Muhammed and the other associates refused to provide the address of the Subway location. The other male associate stated that he did not understand and that it is only $5. He and the female associated laughed and shook their heads. I provided the police with the address of Millenium Station, because this Subway is located inside of Millenium Station. As I waited for the police to arrive, I asked the associates for their names. They refused. I told them they are not wearing name tags. I informed them that I will be taking their pictures for documentation purposes. They objected. One female associate ran to the back of the restaurant. I took the pictures of the male associates. Muhammed said that he was going to get the police. Muhammed returned several minutes later with the police. The police officer said that if this Subway has a no refund policy then I must accept some other merchandise. I said I do not want another sandwich. I have waited 20 minutes for my $5.27. The officer asked if I could get something else besides a sandwich. Muhammed said I could have any food but no refund. I requested $5.27 of cookies. The female associate who had returned from the back provided me with 12 cookies valued at $4.69 plus tax. To my knowledge, my sandwich cost $4.75. I was not provided with a receipt. First, the resolution I sent is to be refunded my $5.27. Second, Subway needs to practice safe food practices and cease selling spoiled food to consumers. Third, Subway needs to display a clear written "no refund" policy.

FAIL! Really? The Chicago PD has nothing better to do than respond
to complaints over a $5 Footlong?

And how exactly were "their food safety practices appear
questionable?" Other than your sense that the sandwich smelled odd
(which may or may not have indicated it was spoiled) you provide no
additional proof that they were lax in food preparatory safety.

While it makes for a far more interesting letter, it's typically not
wise to throw baseless claims like that around - especially not to a
corporate entity.

I can't believe you called the police over a $5.00 sandwich! You
didn't even know for sure the sandwich was spoiled and they did offer
to make you another. You took this too far.

How can you tell, to me every sandwich smells spoiled which is why I
refuse to eat there.

As for everything else, you seriously called the police because of a
sandwich you "think" was spoiled. And what proof do you have that
their sanitation standards are low?

Seriously the cops have more important things to do. Take the offer
of another sandwich and or the cookies and leave.

How do you know his name was Muhammed? You said none of the associates
were wearing nametags and refused to give you names.
