Want to join class action law suit against T Mobile? Rip offs?

I filed an earlier complaint that t mobile did not offer service where I was moving yet eric cs said even if no coverage I would be charged a 200 dollar earlt term fee. I got a call from a matty setta? 877 290 6323 x 3418060 executive office who left a message to call her back after several attempts and a week later she called to tell me t mobike does not guarantee coverage and if I did not continue to pay to get no service I would be billed $200. I told her no judge wiyld expect me to pay monet for no service she said u would have to pay. I said see u in court. If u have been ripped off from t mobile and want to add your name to a class action law suit let me know you are not alone

Cancel my account of eight years with no early term fee this is how you reward eight years of being with you?

i would love to join the law suite against t mobile. i dont even know
where to begin. they make changes to my phone bill with out my
promition, change plans then want us to pay for it, double billing me
and if i dont pay i will loose all of our phones and i have 8 phones
with them, thats 2 accounts. I have been with them for 9 yrs. i am so
done. they were a good company but now they are making us pay for
things that are not even there yet. and when you block something they
still charge yopu and let it go threw. i want to cancel but to much
money to switch everyone and they wont let us keep our nubers. i want
to suit them!!!!!!

Count me in!!!!!! They are the most corrupt pos company ever!!!!!! My
final bill 552.00 79.66 of it is my final bill charges which they say
aren't prorated and i was only on their billing period for 11 days but
somehow my bill is 80 dollars for a full month. On top of that $200
etf and $200 migration fee. I went through 8 phones in 3 years and
they kept promising me every phone would be better. I bought a
sensation in 2012 while on unemployment for $240 and it crapped out in
8 months. the replacemnet sensation they sent me in oct 2012 lasted 3
months. Then they say here's a free smasung galaxy s blaze for free.
Starts having problems 3 months in so i think i'm gonna get the Iphone
5 and then i'm told i have to pay a $200 migration fee if i want the
iphone 5 so I can switch to their simple choice plan. I had been with
them since 2004 in college. 9 years! Loyalty means nothing to
them!!!!! they roll out the damn red carpet for new people but their
current customer they drag through the dirt. They are the most shady
pos company i have ever dealt with. Screw you
tomobile!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!Btw your no
contract plans suck ass!!! Who really wants to be in debt for a damn
phone?

Please count me in! I hate T mobile. I joined T mobile this year in
January. I was so excited my wife and I got the samsung galaxy note 2
for me and my wife. We lived in Ohio and had no service. I called to
take care of the issue which was not a big issue cause I was moving in
a few weeks to Savannah, Georgia. I asked the lady hows the service,
she is like oh its great 4G every big town big coverage. Moved down
here have not had service at all. Since then I have called in
multiple times and have had no service and issue not resolved. So
finally I screen shot all the times my phone read no service, wrote
down all the fail calls, and had others call me and record their
results. They were willing to give me a etf without the fee or so I
thought. Faxed in my info and they shut off my phones due to non
payment on the bill. I mean how fair is it to pay a bill for
something you do not recieve and I paid all my bills til april 12th.
This is not fair. I have no phone service not even wifi. This is how
a paying customer gets treated. So I walk into the store to resolve
this and they are like you owe us 564 dollars plus 178. How is this
freaking fair. I was told I would not have to pay anything. I want
that company gone and to no longer exist, they are scum. They have no
professional decorum at all, no respect, and no follow ups with
customers. Go to hell t mobile!

I was with T Mobile family plan for over 10 years. When my children
left home and my husband died I went into T Mobile to change the plan.
They said I had a contract and had to wait until 2014 to leave them.
Then they said that if I left early and went on their current "no
contract" I would have to pay $300. I switched to AT&T about 3 weeks
ago. T Mobile send me a final bill for $693.65!
Unbelievable. Add me to any class action lawsuit against T Mobile.

I want to join! Im on a family plan, and just upgraded my lines (8/12
and 2/13) Now they have no contracts and if I change my plan, I have
to pay $450 migration fee!!!! They are insane!!! I called cs and was
told "When you got a discount on the phone you have, we actually over
charged you on your phone bill every month so its not like you were
actually getting a discount" WTF does that mean? My bill hasn't
changed in years, I pay no more/ no less...

I purchased a Galaxy Tab 7.0 in 2011 with the understanding that it
was just like a phone, if I had a problem the local Tmobile store
would update it. Little did I know that was a LIE.
March of 2013 I am sick of not having reliable service 300 feet for
their store, I go in wanting to disconnect service. Sales person
convinces me to get new phones and they'd disconnect the tablet at the
end of the billing cycle.
Now today we have a new bill for 2 texts and a new bill will be coming
for the ETF for a crappy device they sold me under false pretences
(obtaining of property by intentionally misrepresenting a past or
existing fact ie: that software wouldn't be ungradable to newer
standards).

Apparently Samsungs contract w/ Tmobile was for no updating of
software making the tablet obsolete within a year. Maybe I should be
complaining to Samsung as well for their stupid no updates contract.

As I was getting closer to being able to cancel my account with
T-mobile. I started getting overage charges on my account that can't
be explained. They say we must have switched calls and the person
never hung up? I don't get this at all. Would you stay on hold for an
hour or better? Supervisory disconnect should work in this case.

I was a week before my contract was up when the last number was ported
from T-mobile, they cancelled my account. and my web account so I
couldn't see my account information. The collection debt uses fake
caller ID calls my son and harasses him.

The customer service is by mail only, they will not give you an email
address, or phone number. T-Mobile is a very sad and follows bad
business practices.

i recently purchased a new phone for my daughter, and was taked into
signing a new two year contract, (mine was expired) the promised me
everything, including me getting a "free phone" upgrade, at the time I
was talking to the representative I didn't have time to look for the
phone I wanted, he assured me that I could do that at anytime....so in
March when I went on line to look, it showed no phones available,. I
called them and they told me that everything changed as of 3/24/13 and
that the free phone was no longer available, but they were happy to
sell me some very expensive phones. I asked that since they didn't
keep their part of the bargain they let me out of that contract but NO
not possible..they need a class action law suite for many reasons
filed against them,this is one of them.

Well They told me that their online information is incorrect. That my
plan doesnt reflect the new charges online just on the bill...funny
because my bill says the same shit...tired of them been a customer
very loyal for the past 9 YRS..;. I call bullShi77tt I have overpaid
20.00 a month the last 4 years they dont want to pay up for their
mistake so the blame the internet for being wrong....

Hi,
our names are very interested in joining the T-mobile class action
lawsuit, we live in the Detroit Downriver area, our names are Tom &
Roger, and have had multiple problems with T-mobile, including them
forcing us to pay more than our contract, bad service & no service at
all in many areas, charging us a huge cancellation fee even though we
only cancelled 5 dyas early and still paid to the end.

Please let us know , we also are getting SCREWED BY TMOBILE, we are
supposed to be out of our contract 4/13 and now they are saying we
extended it, no way in hell. I want to join the lawsuit also, ready to

I have been a loyal Tmobile customer for about 15yrs now, and recently
(1yr) I have had horrible service. My wife and I use these cell phones
for our business numbers, but we are constantly getting dropped calls
and "no network" when trying to make calls. Also, we will get messages
to our voicemails with no missed calls on our phones. We must have
good reliable phone service to conduct business efficiently. Tmobile
has horrible service now and will not let us out of our contract
without charging an ETF. I have no problem in paying $400 for the ETF
in order to get reliable service. But I don't understand why Tmobile
would still charge that being that my service has drastically
declined. I AM DEFINITELY ON BOARD WITH THIS LAWSUIT! (even though I
have my doubts any resolution will be resolved, being there
"Arbitration" clause)

I canceled my service and Got hit with a $500.00 bill. I never
received such a high bill for 10 years with them. When ever i was over
$150 or late they shut me off. I want to be part of this law suite
count me in.

I would love to join this class action suit. My two year contract that
I signed up for in January of 2011 mysteriously got extended without
my knowledge or permission and now they are demanding we pay them the
early termination fees. There is more of course because it's TMobile
and they are full of lies, but this is the most pressing issue.

Absolutely!!!! They've been ripping me off for 15 or more years and
particularly recently!!!! And I can't even connect to the internet 90%
of the time. And I have been with them since 1998............they
sucker me into a new contract every time I make a change in service I
found out a couple of weeks ago when I went into to upgrade my phone.

We had the problem of bad phones. They kept sending refurbished phones
that never lasted very long, till we had to turn them back in.Finally
they sent a phone that already had water damage to it.We took it right
to the store to show them.We shipped it back and I was charged for a
new phone, due to water damage! Then they sent another used phone.

Now I am getting doubled billed by the handset insurance.They refuse
to credit my account

I would join too. We switched from Verizon since our bills kept going
up. We went to the Family Plan. When we purchased our phones they were
under a promotional offer of getting $100 in bill credits per phone.
However, 4 months later, they will not issue us the credits. Each
month, I call and ask them to do so and they say they are submitting a
ticket with their supervisor and I will get the credit next month. The
next month no such thing happens and I have to waste my time calling
again to be told the same thing. They claim they are having "issues"
with the system. For 4 months? That means you aren't trying to fix it
or you are lying. And the fact they "don't have the authority" to
issue out any credit to an account manually is ridiculous. They've
created a system to take advantage of people and lie to them about
getting promotions and then never actually give them. That sounds
worthy of a class action law suit to me.

I have been with tmobile for six years now. I had a separate account
for internet service. The service was for online schooling. I kept
having problems with pages loading, internet continuously
disconnecting, not being able to access my classroom, internet
disconnecting in the middle of tests, being told I was over my usage.
Tmobile kept telling me there was an issue with the towers. They were
to send someone out to fix it. I had this issue for over two years.
Every time I called I was informed that the issue was being looked at.
I was also told that I kept going over my data usage due to pages
reloading after disconnection. I doubled my usage and my bill. I kept
having the same issue over and over. 6 months before my contract was
up, I had had enough. I refused to pay my bill, owed one month plus
partial as they disconnected service for non-payment. I heard from a
collection agency who gives me an amount owed for service of amost 300
which equals three months service, remember I owed for one and a
partial month, also included in the bill is another 200 for
discontinuing my contract (which had only six months left) and another
140 for collection fees. I have contacted tmobile again and was told
that they filed a dispute on my behalf. I should hear something in ten
business days. I would like to find someone who is filing a class
action suit against them. I paid for services that were not provided
as promised. I had to go to hotspots to complete homework and tests
wich meant sitting in my car in a random parking lot late at night. My
daughter was also to use this service for her online schooling but we
could not load pages or keep internet connected. I finally had to find
another internet service provider. Tmobile could solve this issue
immediately by adjusting my account for periods I was unable to use
the service and prorating the disconnect fee but we will see what

I want this resolved before it damages my credit.

I have same problem ,same like you.But my one is little bit
diffrent,they agreed to waive my early termination fee for my
three(3)lines $600.00 after suissed to another provider they rfused.I
have the employee name and id #.who asssisted me.

I have been a customer for over 8 years and was out of contract for 1.
I decided that I wanted a data plan and was sold unlimited with a
HTC1. I had it for a month the data was a little slow but I was OK
keeping the phone until I received a txt saying that I was over my
limit on data. I contacted them and was told that I was in a roaming
zone and should not have been sold the plan. I made arrangements to
return the phone and requested that I be returned to what I had before
NO CONTRACT! I was reassured on multiple occasions this would not be a
problem. I later called after they had received the phone with no
credit to my account and told that I was under a new two year contract
with absolutely no benefit to me no phone, out the money I paid for
the new phone and no data. I filed a formal complaint and have had no
satisfaction from the company. Hell yes I would like to file suit.

How do we join the class action lawsuit?

My mother and I are on a family plan. That have kept us going in
circles. We never get a straight answer out of them, EVER. Example: We
paid our balance in full less than 3 wks ago. This morning they say
they're going to cut us off, saying we owe $360. Our bill is supposed
to be around $150. My mother said, "How is that possible? We just
paid you in full in mid Dec!" The rep put us on hold several times,
stating "Yes, you did pay the balance" then kept mentioning past
cycles. It made NO sense. Merely a distraction strategy. They've over
charged us over and over again like this and when I could rarely get
service in Hawai'i for 10 months they wouldn't do anything to help, or
let me end my contract without fining me $200. I was always borrowing
a phone or using a payphone. They wanted me to buy a mini tower thingy
to improve my service. I refused. Then they offered it free providing
I renew my contract. WRONG AGAIN. We plan to end our contract but they
will fine us $200.
How can this be legal!!!!!!!!

Can anyone help us? Or PLEASE.. tell me who to contact regarding this
lawsuit!

I am using t-mobile's network through a company called
http://www.solavei.com/sharenow. I tether internet access from my
phone through my laptop. My daughter has the same type phone but can
not do so. she is with t-mobile directly. I recommend if any of you
like the t-mobile network to use it through another service provider.
I like the company I''m with although they use the t-mobile network.
I'll check with my daughter about joining the lawsuit cause verizon
just lost a lawsuit for blocking tethering on an unlimited plan.

I want too!!!! I live in Jackson, Mi they suddenly left the area.
After 7 yrs of service there was none, the final straw was when I had
to go up the road to call 911. If my husband had a heart attack I
would not be able to call 911 for help. where as before I was able to
I stayed an additional 5 months trusting they were going to fix
service problem I drove 50 miles out of my way to have new cards for
my phone still no service they were jerking us around. now they are
trying to charge me for cancelling service when in fact they cancelled
service to me. now have ruined my credit and turned acct over to a
collections agency. I informed them how angry I was and told them no
more $$ was coming their way. They wanted me to buy a device to
enhance my services. Absolutely not! ^ months before this I
upgraded my phone to a 4G. It was over $300.00 I still have that
stupid phone that does not work in my town. T-mobile sue me I can't
wait to see you in court!

I am sick of being lied too by tmobile reps....I was told that while I
suspended my account due to theft I wouldn't be responsible for my
monthly bill... That was lie....when I requested the review call the
Supervisor attempted to explain how that wasn't a easy
process...that's bull....you want to hold me accountable for your
crappy agents...now I have a 1000.00 bill. I seeking a lawyer to
assist with suing them....I have been a customer for 4 years and I
hate that company

Add me in as well. I have a tablet account listed under my family
plan. I chose to sell the device because I was just unhappy with it,
its a Dell Streak 7 and a poor bran name. Tmobile refused to credit me
for service I couldn't use since I sold the device. A complaint was
filed with the FCC and my contact number was put on it to reach me.
The Executive office rep kept calling my mothers line instead of the
number given. She did this just so she could say she made attempts to
reach me, her reponse to the FCC states she won't credit me for unused
service or even provide another device for me to use. Needless to say,
I'm supposed to keep paying for unused service? BS!! Its gotta be
illegal to charge people for something they have use when they have no

i was lied to as well, i have been with them for 6 years with two
different accounts, mind you my account number was changed because of
something they had to do. I canceled because i was tired of always
calling to have the credit my account for money i did not spend and
for my phone. Basically the money i paid them meant nothing when it
came to actually replacing my phone. So i canceled and moved on. They
are calling me every day two - three times a day and sending me
letters threatening me because i wont give the $600 in one month. I
told them that right now i can only afford $25 a month. They told me
that even though i pay $25 a month they will send my bill to
collections. Isnt there a lawsuit i can request for them threatening
me with something they can not do and harrassment for calling me
non-stop even though i told them my plan and pay them $25 faithfully
every month?

We were lied to also. We moved from Minneapolis MN to Duluth MN were
told we would have wonderful service in Duluth. Ha,it is terrible at
best. I have been given nothing but the run around from all the
customer service clowns. Please let me know what I need to do I want
these people to stop praying on other unsuspecting victims. I was told
I would not be let out of my contract and as I was being told this low
and behold the call dropped!

These people are insane! I have been harassed for EVERY thing I tried
to do with this company with the exception of paying them monthly!
Assurion is a rip off joke at best, and Tmobile simply talk around
you. They don't like it when you tell THEM you're RECORDING THEM
because they KNOW they are rip offs. I have had NOTHING but problems
with them. My husband opened my son's first phone account with
tmobile, insurance the whole get up. He got a side kick something or
other. Well I guess it was oh I don't know a few months (I seriously
can't remember all of this off hand) and the phone just wasn't working
right so we go to tmobile where they proceed to tell us this wasn't
our phone, that wasn't our account, and to this day they tell us my
husband's social security number isn't the one they have on file.
WHO'S????? They won't tell us! So after a little over a year of
constant fighting with tmobile and assurion, we get the replacement.
Some funky phone. Again, insured it and all, had to go down to the
store to prove my husband WAS indeed my husband, he had to show them
his ss card to prove that that WAS the ss number (remember to this day
they say that still is not the ss on the account). I had to show my
identification as well so that they could talk to me about the account
as I wasn't there the day they opened it but I was the one that
actually managed it. No matter what I try to do on this account unless
its paying them, I am harassed. My husband took my son finally after
another disasterous incident (which we're still dealing with), to get
his own account in his own name so my husband and I wouldn't have to
deal with this UNBELIEVABLY DISHONEST company! Well after I sent my
phone into the preaddressed address and made sure they received it, I
called to close the original account, my son's. they raw jawed for a
while then told me they needed to speak to my husband because he's the
original account holder I handed my husband the phone (he was home at
that time) and they were giving him a hard time, and he finally told
them he was tired of being harassed and is NOW RECORDING THE
CONVERSATION, they stated we had no right to record OUR conversations
but they have the right to record theirs, and promptly hung up! So I
got a bill. I also got a note stating that my son's phone had water
damage (they had to say THAT because that phone had been taken such
good care of it was SICKENING!) it was in such good condition, it just
didn't work anymore. NOT THROUGH LACK OF CARE but through lack of
UPDATES that were not provided thus the phone couldn't keep up. Now I
call and ask how is it I am STILL RECEIVING bills when we clearly
stated last call we wanted service CANCELLED! They will not close this
account. I have had NOTHING but attitude from this ridiculous COMPANY!
I want the cost of the 80.00 pos I have to pay for because they're
SCAMMING me and that's all they so is SCAM! They blocked me on
facebook because I was letting them know how awful they were, they
didn't offer to help me or speak with me they blocked me! THEY ARE A
RIP OFF COMPANY AND I WANT IN ON THIS LAW SUIT!

Would some one please help us stand up to T-Mobile. I have now been
sent a third phone in a six month period. They know this device is
defective. I pay my bill every month, but for what reason the last two
phones have not worked properly. Please some one help us fight this
giant.

for my house...I'm at work over 8 hours a day -_-". What good does
that do?

I'm IN, I've been with T-Mobile for 6 going on 7 years, and the last
three years has been declining network coverage...severely.

yes for me too. they said if i signed with them last year i wud b
getting coverage with att towers due to merger coming up. also said my
data plan was 2g same speed as 3g except for videos but it is way
slow. No way

I would definitely like to join the lawsuit. I filed a complaint as
well with the BBB. T-mobile wont allow me to cancel my contract w/o
etf fees even though I do not get much service in my neighborhood.
They said on the map it says it is just above poor service which does
not qualify me for exemption from etf fee. They sent a tech out here
who says I am in a low service area which is why they have scheduled
towers to be put up in 2013 but what about now and from 2010 when i
was calling about poor service, I barely get a line or no service at
all, I have a lot of dead spots which causes me to constantly drop
calls. They also told me they can order me a cell tower booster which
they did and then i received a text the next day saying the order was
cancelled. I then called to ask why it was and they said I did not
qualify for it. The why did you make me order it and also was approved
by tech support when I did at the time only to tell me I dont qualify
for it anymore. One supervisor lied and said I have gotten a credit in
the last few days from a manager because of complaints when i told her
I didn't that it was for the cell booster they charged me for that
they never sent me she then revised and said oh she was trying to give
me a credit is what she meant to say when I asked to talk to a
manager. Her name is Kenya H. I spoke to Tech Support Manager who said
my services was not good in my area according to the technicians
report they sent out here is his name is Ambrose only to find out from
the termination department by Neil that it is??? I am like what
monkeys do they have working at T-mobile that they cannot get their
facts straight or even realize that they are dealing with adults not a
bunch of kids that are gullible to childish lies. I am so fed up with
them I am ready to take some real action.

contact Change.Org. Petition has been filed. T-Mobile has ripped off
too many consumers. So, check with Change.Org regarding petiition

I wish to join a class action lawsuit against
t-mobile. They sold me what they called unlimited internet service,
then throttled it, saying that I used more than my alloted 5g's with
an offer to restore it and increase it to 10g's per month, if I agree
to pay $30 more per month. They have their shite the scammy little
scumbags. They sold my friend a hot spot and a second line that never
worked then charged her $400 early termination.
Well Im early terminating them and they are not getting any money from
me. Im hoping that they sue me so I can counter sue. but a class
action is much better. I ho[pe we can get it to take off.

Yes I would like to join a law suit against T mobile. I have been a
customer for 6 years myself and they never keep up their end of the
deal anywhere I go.I live in Texas and their service is non existing,
even in my own house I don't even have one bar! I feel that I keep up
my end of the contract and paid them over 350 dollars a month for 3
lines,yet they can not keep their part of the contract. it's not 4G
It's 4C FOR CRAP!!

Yes I would like to join a law suit against T mobile. I have been a
customer for 8 years myself and they never keep up their end of the
deal and told me I would be charge an early termination fee for ending
my contract. I feel that I kept up my part of the contract and have
faithfully paid them over 250 dollars a month for 3 lines, with no
interupptions in paying my bill and yet they can not keep their part
of the contract and get off free. It's just not fair!

Hi i'm having the same issue with my data service, i use to be with
sprint and i wanted to switch because i didnt have no internet
coverage and i went to a tmobile store and gave them my address and
they said i would be covered. Long story short they lied and told me i
couldnt get out of my contract and they dont gurantee service. They
even suggested that i continue using my comcast wifi cause there is
nothing they can do for me.

my name is Yvette Mancuso i live in Plattsburgh NY. I was a customer
of tmobile for over 2 years. First nothing but problems with their
phones, no coverage, dropped calls terrible service, lucky we ever had
over 1 bar at a time. I had two lines to start. in the first year i
bought a total of 6 new phones, which i paid for. 4 of these phones,
they said i could get a rebate for did all the paper work copies of
what i needed. Never got a rebate. was told i didn't do this or that,
or i didn't fill something out right. whatever. then the phones i did
buy most times had all these problems with so each time they had me
send it back and they sent me another one i was charged at first
5.00even with insurance, and then it went up to 20.00 cause they
switched insurance without me knowing. nothing but problems. then my
two youngest wanted phones so i was like ok. i will add two more lines
and get new phones, and give the younger two older phones, told
tmobile this asked if this would cause any problems and was told NO.
come to find out, when the new phones got damaged and one old phone. I
was screwed because the phone numbers didn't match the correct phones
it voided my insurance on all my phones, so i wasn't covered. so for
almost 2 months i was paying for 4 lines and had 1 phone that
actually worked.
called tmobile, also when i added 2 more lines, they started my 2 year
thing all over again. I had one month to go. if i knew they would
start my contract over i wouldn't of gotten 2 more lines. because the
service sucks, and dropped called and no service, and more dropped
calls. finally i called and spoke to a rep and told her when my
monthly time ran out i already paid and when it was up i was porting
three numbers and cancelling one number, cause i only needed three
lines and i needed a service i could rely on. was told i would have to
pay 200.00 per line. even though i ported three lines, ok whatever
cause of the thousands i had paid for over 2 years for crap whatever.
then i get the bill it's 800.00 for the 4 lines and then another
400.00 for what i have no idea. i have all the phones i bought.. and i
have new phones i got with the new lines and both dont work. i am so
ready to sue, so add me up please.

Yes, I am in the same situation after being with them for seven years.
They want me to pay for a service with no reception. I have been
paying them for two years with no reception. When my son who recently
went to college got in a car accident and was not able to reach me
because I had no reception, I decided that I will no longer be coerced
to paying for a service at the risk of my family well-being or safety.
Now they are charging me $1200.00

In 2010 i was told if i got a blackbery fone that id have
unlimited minute, internet, texting anywere in the united states for
$100.00 a month.
I was getting bill from $300.00 to $400 a month. so they lied to
me.

T-Mobile deserves to be sued BIG TIME for ripping off it's customers.
They extend your service contracts without your permission. I have 1
mo left on my contract. I got horrible broadband service and they
charged me a n early termination fee ogf $200!! I ubderstand their fee
is supposed to be pro-rated, but more importantly they are liars. I
never agreed to any contract extensions!! BRING ON THE CLASS ACTION
AND GET THEM BASTARDS!!!!

Yes.

T Mobile baits and switches your account. Told me I was in a contract
and I never was. They want me to pay an earlier termination fee to
get out and for the most part of this month I have had intermittent
service and access.

Yes. T Mobile began charging me for checking voice mails (not in my
contract) and for calls that T-mobile made to me! It also was
charging me for incompleted phone calls. I refused to pay for these
overcharges, and now they threaten to sue me.

T-Mobile started out as a good company. We were with them for many
years. They went bad after ATT tried to buy them out.

I am with you all the way Tmobile breaks privacy laws & gets away with
no honoring the buyer's remorse clause in their own contract they need
a class action against them. I tried to get out of a new contract that
was withing my buyer's remorse and drove back to tmobile location 5
times and the fifth time I even got the guy to sign a paper stating he
was refusing to return my phone & plan within the buyer's remorse on
the date he refused and he wrote the statement and signed it with that
days date. I drove back one last time a 6th trip down there and they
took back my smart phone but still refused to take back the plan. I
live in Washington & had no problem with the service, I just realized
it was a financial mistake I couldn't afford and legally they should
have had to return the plan & phone since that's the law and what
their own contract states. Today I called about a friend of mine's
phone because I got a phishing text that best buy told me to report to
my phone company & don't own the plan and only entered my tmobile
phone number to my friends account & they wanted me to verify last
four of his social to report the issue & I said I am not the account
holder I just use his plan and I will not be verifying any social
numbers that I do not have, I shouldn't have to do all that to report
an issue like this & then they proceeded to give me account details
about him being overdue for a payment: how is that not a privacy
violation? start a petition & I will sign it, also get organized you
need enough ppl to get an attorney to sign & if tmobile is breaking
all kinds of laws that they appear to clearly be doing they need a
class action brought against them contact me on

I want to join this lawsuit against tmobile too.After 3 years of never
being late paying my bill, they changed my billing date, and when I
told them to change it back, they charged me for a pro rated bill on
top of my normal bill.And when I refused to pay it they shout off my
phone .So I canceled and got hit with a early termination fee which I
refuse to pay.

I have been a loyal customer of T-Mobile for about 9 years. I
purchased a smart phone and about 2 wks later, I had no service in my
home. I jumped through all T-Mobile's hoops as they claimed there
were active service tickets for my area and they would be fixed.
T-Mobile offered to wave one months billing because they felt so bad.
I needed to renew my contract to do so and at this point, I was still
loyal and had every confidence they were sincere in their attempts. I
thank them profusely! However, T-Mobile not only renewed the contract
on my new phone but also my husbands very old phone. To bad for me!
If I wanted to use my phone, I need to step outside and search for
service. I have some health issues and need to be in touch with my
doctor. T-Mobile's response to that was that I could always call 911.
They also made it very clear that I was the one that signed the
contract. The contract states that they do not guarantee service.
I'd had service for 9 years! The BBB was contacted and T-Mobile
continued to state that the situation had been resolved. Nothing had
changed and nothing had been resolved. As T-Mobile says, my billing
does show that I used my phone. I switched to another carrier and
T-Mobile can now reach me on my cell, go figure! Of course because
they renewed both the phones, they are demanding large cancelation
fees. The short of this is that you purchase something from T-Mobile,
that doesn't work and you have to pay a fine. They have no moral
compass. This company is as unAmerican as anything I've ever

You can absolutely add me to a class action lawsuit against TMobile.
After over 5 years, I lost good service out of the blue. After some
research, I was told that the reason is that the deal between TMobile
and AT&T fell through, and TMobile was kicked off the AT&T towers.
Yet, TMobile continued to bill me even though I and my son repeatedly
complained for little or poor range. They kept telling us, "we're
working on it". So I finally just moved to Sprint. TMobile decided
to bill me nearly $1,000. No way am I paying this. For two years I
faithfully paid my bill without getting what I paid for.

T-Mobile seems to follow the same pattern with consumers using the
excuse repeatedly that T-Mobile is not responsible if consumer has
problems with service issues. Secondly, charging unfair termination
fees. T-Mobile maintains there are several factors including network
changes, traffic volume, service outages, technical limitations,
signal strength, equipment terrain, foliage, weather and other
conditions that may interefere with service and quality. T-Mobile's
claim their terms and conditions of service include they are not able
to guarantee coverage or service at any time. It is abhorrable to
tolerate such insolence from this company. If enough consumers write
to the FTC, BBB, PUC about their experiences with T-Mobile the
agencies will act when they see a pattern of violations.

I have similarities in my case as Sherlei L. My complaint with
T-Mobile is with a data stick. I also was told by T-Moible "unable to
guarantee coverage". I was expected to pay for substandard service
month after month. Started business relationship with T-Mobile by
obtaining cell phone from 12/22/2009 to 6/30/2012. Inspite of my
relationship with T-Mobile it ended negatively. T-Mobile intent on
charging me $200 termination fee, in addition to tacking on a sum of
$43. I've been ripped off by T-Mobile and fully sympathize with
Sherlei L. You can count me in to join class action lawsuit...

Oh, helz yeh. I've just had online conversatons with their cs and
alluded to the fact that I was going to look into a class action
against them.

Where I live, their service is so spotty, I cannot make a phone call
in my own home! (Like who would want to make phone calls from their
home, right?) And it turns out my entire area can only make calls from
within the home "occasionally"! Really???? Only occasional phone calls
from within my home? Or in a satellite building in a shopping center,
or in the lobby of an office building, or, pretty much inside ANY
building!

Oh! but they did offer a "free" signal booster --- if I signed up for
extended service on a new two-year contract! And, bear in mind, I am,
according to T-Mo, signing up for the extended contract in order to
cover the cost of the signal booster (which they claim is $500 (Like I
don't know I can get it for just over $100 at any computer store or
online tech site!)) - BUT, when I end my contract with them, I don't
get to keep the signal booster which I have ostensibly paid for. No.
Rather, they keep the signal booster to "sell" to some other poor
schmuck.

Okay. Maybe I could live with that, HOWEVER, T-Mobile was fully aware
of this situation and failed to reveal that shortfall at the time of
signing, a fact which was - probably inadvertently - revealed to me
during my online with their customer service department. This, to me,
indicates a WILLFUL AND KNOWING LACK OF FULL DISCLOSURE and,
therefore, negates the entire contract!

I was advised that I can only cancel my contract for poor quality
within the first 14 days! I, in turn, advised them that my complaint
was not about poor signal quality, it was about their failure to
disclose that information at signing. And THAT clock does not end at
14 days!

Class action suit? It cannot come too soon!

I'm tired of this Tmobile service! In January we changed over from a
pree paid account to a post paid account. Every since then we have had
nothing but problems with service. I want to cancel my account because
of the horrible service. I was informed I would be paying a 200
termination fee X 2 for my phone and my husbands phone. Sign me up for
the class action lawsuit. No service and poor service reception are
grounds for loosing customers. Are they going to pay me for all the
missed work I have from not receiving from loss of reception? Are they
going to pay me back for all MY hours spent on the phone? Are they
going to pay me back for all the 3rd party telemarketing calls and 3rd
party charges I've been getting on my bill that I never signed up for?
Every month it's the same thing since January 2012. I'm done! Count me
in on your class action list.

i would like to join. however, according to the contract and all of
the big cell providers do this now, we MUST resolve thru small claims
or via arbitration. this was argued all the way to the supreme court
and, led by that fuck, Scalia, it was decided that it could be made a
law that cell service consumers must use arbitration or small claims
only. which, of course, limits our power. who is going to go to court
for a hundred bucks, or $30 or $200? so, we need to get groups of 49
(once it is 50 it;s a class action) people and file together, perhaps
using the same law firm.
i am in NorCal. anyone got a plan how to do this? or, we do get a
class action going to sue the supreme court for being idiots. there is
no law against that!

I would like to join the lawsuit. They have horrible service (both
coverage and customer). I have had many dropped calls, emergency mode,
sd card removes itself, feed back on both ends (echo or crackling)
etc.... I have had my phone replaced at my cost several times and
sometimes the phones they send are worse than the last. To compensate
they told us they would up our GB and lower our bill. But, they didn't
tell us for two months and a two year contract.They also won't let us
lower our services without extra fees now. I want to cancel, but will
get charged.

Yes, I wish to join you. I have the exact same situation as you. I
have been with tmobile since 2003 and have never been late with a
payment. I am moving to an area in N.Ca. where there is no coverage. I
would not change if they had coverage.I also have called the Executive
Team/ Office of the President at Tmibile. They will not accept a phone
call. I had spoken with one of their reps in the past and have her
extension X-3418023 Renatta Clay. I have left several messages and
they refuse to contact me. What arrogance.

What can I do to help and where are you in this crusade.

I would love to join in if someone starts one. I am sick of T-Mobil.
From the first day I bought my phone I had problems that I couldn't
fix through Tech support, then when I try to get them to help me they
won't. I pay my bill and they charge me five more times. I am sick of
them and the lies. I was promised my rebate and then told I gave them
the wrong MEID number for the phones we bought. They refused to return
our money and now want a cancellation fee, and to top it off we were
told that we paid 300.00 in cash for our first bill because they wont
take credit cards for the first payment only to find out that the guy
stole the money and never turned it in. The icing on the cake came
when we got our bill and were told that we had to pay more money for
our phones even though we were told the initial purchase price let us
own the phones. This company is the worst ever. Please let me know if
anyone knows of a law suit that is on going against them. I know

I am in! I think they are illegally charging termination fees when

I like to join in, I bought a phone back in April and got insurance on
it but when I lost the phone on my oversea trip, they first told me
that I didn't buy the phone that I was giving them the IMEI # to them
from them. After many hours of giving them date and everything else
they asked, they refuse to give me a replacement phone because I
didn't make a phone call from that phone even thought that I paid for
the service. So I canceled with the promise that they won't charge me
with the cancelation fee. I didn't get the rebate that I have mailed
my forms before I left on my trip. When I called, they told me since I
cancel on week 7 I won't qualify for the rebate since they have up to
8 weeks to respond. All of these were done June/28/ 2012 and today
7/17/12 T-Mobile sends me a bill for the cancelation fee. I can't
believe it, please help me to get some justice.

I continue to have problems with Tmobile adding additonal charges to
my monthly statement "withOut" my approval. I end up spending tons of
time to finally catch up with the Yuma, Az manager to address this
and finally do only to have him remove the unjust charges and then
they are put right back on despite my complaint
I also keep telling the local store manager that my reception is very
poor and nothing is done abaut it.

Yes, I want to join the suit. I'm a Disabled Vet and have no coverage
most of the time where I live in Maine. That's bad enough, when we
travel south for a few months in the winter we are amazed at the
amount of time we have no service.The final insult is when we get to
FL. the north central part we have no service where we stay. $156.00 a
month for pretty much nothing. This is the worst cell phone company I
have ever had.They would not cancel me ever though they could not
furnish service where I live. Seems to me if you can't furnish the
service you should let the contract become null and void. I can't wait
until my contract is up.T-Mobile sucks

I would like to Join we started our service with tmobile in 2010 and
our bills were always 120.00 we added a line which was only supposed
to be 130.00 a month we received a bill for 849.00 which they said was
due to over limits on data now we have received a bill for 1153.00
after our phones were suspended I have had it and the people were all
rude and refused to set up any type of payment never received a bill
either in the past 2 years count us in

Sherlei, are you still working on this? I have had nothing but bad
news from T-Mobile, and I see several remarks here from people who
have had the same experiences I have. I am ready for a class action
lawsuit, and if you aren't going forward, is someone else? If not,
let's get together and get this rolling!!

Yes-count my husband and myself in!!!! They are lying crooks. We
were promised all kinds of things to get us to sign a 2 yr. agreement
with them. They have now changed our data plans and service around
and simply say "I'm sorry you misunderstood what you were getting".
They are taking away my wi-fi hotspot, even though I confirmed ahead
of time that it was included. I must now pay 14.95 per month extra
for it. They took away the promise of unlimited data...I must pay
25.00 per month extra for 5 gb of data. They have a coverage map that
is a complete lie. My husband and I have called over and over, month
after month trying to get things corrected with them, to no avail. We
had an international calling plan added to one phone due to a trip we
were to take overseas this past January 2012. We had to cancel the
trip, so we cancelled the plan within 2 weeks. I finally got them to
remove the plan today, June 8th, 2012....5 months of arguing with them
to get them to take the plan and the charges off. The plan was
supposed to be $5.00 per month....it was really $15.00 per month.
When I call about it, they continue to apologize that I
misunderstood....SO FRUSTRATING!!!!!! I could write a book on why you
should NEVER go with this company!!!!

I will glady join a law suit against tmobile. I've been with them for
over 8 years as well, loyal, always paying, never complaining, etc.
They breached my contract at one point, adding a service without my
knowledge and refused to refund my money. Once you breach a contract,
the contract is void. I had been planning on switching to another
carrier. their customer service just made me choice so much easier.
now they sent me to collections and i have contacted their contracts
department over 5 times trying to resolve. I've obtained their legal
department number and going to file a small claims law suit

Earlier in April T-Mobile informed it's customers that their data
allotment will be reduced drastically when roaming -

So if yo had 5GB of high speed internet (which they call unlimited
btw.) you now only have 100MB which is about 2% of the service they
promised us to provide for a specific amount of money. I wrote them an
email (to customer contract review department), since I didn't get
anywhere with a manager of customer service. They just told me they
could not help me there, when I wanted to hold T-Mobile accountable to
uphold their end of the agreement.
I told them that I either want to be charged less for the reduction in
service or to let me out of the contract, that normally would expire
in another year without a fee, since they broke the legal agreement.
They cannot make a contract that only one side has to uphold, but they
can do whatever they want. If they stop or reduce a service under an
existing contract, then there should be a relief of damages or the
option to cancel the contract altogether. I can understand charges may
go up with time or service to me more expensive, but for new
customers, not for existing contracts. What is contract law if only
one party has to abide by it?
I got a call back from customer relations department that I could not
take, so it went to voicemail and they just told me that I have the
option now to upgrade for MORE money so I receive the SAME service
(that I had before for less money per agreement of contract!). This is
to me an illegal money making scheme of bait and switch. They didn't
even refer to my actual complaint of upholding their end of the deal,
but just told me that I have to uphold mine and they would not let me
out of the contract, no mention of their breach of contract in
limiting a service that I am paying for since I signed up. I wrote
back (since they didn't leave a contact number and it is not possible
to contact them by phone - very conveniently for them!) and told them
that their option is unacceptable as well as their excuse, that I so
far have not reached a roaming limit!!! What has that to do with
anything? That has absolutely nothing to do with the problem that I am
facing when I am traveling here in the next few month and most likely
will get into roaming areas and will be out of service then!
Unbelievable! I was considering a class action lawsuit about this and
was looking for people that have the same issues here.

I have the same story, I moved to Missouri and have no service. They
make me pay the minimum of $17.00 a month or pay $400.00 early
termination fee.I Hate this company and they are very rude to talk to.
I would like to join the class action law suit.

I have had service for 7 years. I got married last year and put my
husband on my family plan. All was fine for a while, then he stopped
getting phone calls or voice mails. The caller would hear 10 rings and
a busy signal and could not leave a message. He called customer
service. They sent him a "new" phone (with no back plate). Same
problem. He called again and again and went through their
troubleshooting process. I called a few times and also went through
the process. This took at least an hour every time. He also went to a
T-Mobile store and had them "fix" the problem. Every csr told him a
different story, and the problem was never resolved. He went through
another "new" replacement phone which had porn downloaded when we got
it. The next one had the manufacturer's symbol worn off from use. The
next one also had no back slide plate and was probably the first
replacement again. My husband was laid off and looking for work, but
potential employers could not contact him. We tried for over 2 months
to resolve the issue with no luck. Finally he ported his number out to
a different carrier and I petitioned to not be charged the termination
fee. I received a letter that stated that it was my choice to not give
them the opportunity to troubleshoot the problem so I would be charged
the fee. I intend to sue. This is wrong.

Count me in. I completed my 2 year contract then I moved to an area
that only recieved service through AT&T and even then it was pretty
poor. Then I could no longer afford to pay $60+ a month especially
for not receiving full service. After not paying one bill promply,
they started sending text messages about cancelling service and that a
$20 fee would be charged to reinstate service. So canceled service
was sounding pretty good and a chose to let it cancel. As expected
the phone stopped connecting to service and I no longer received
calls, texts, or internet service. A couple of weeks later I went
online and paid the full amount due, but elected to not pay the fee to
re-establish service since I did not want it anymore. Again, as
expected, the did not connect to services, no phone calls, texts, or
internet in or out. Two months later T-mobile called to collect $120
due for current services. I explained that I had not received service
since they cancelled two months earlier. Yet they insisted that I was
somehow receiving reduced service (at full service rates) yet my phone
continued to report no network connection. I asked them to remove the
charges. Instead I continued to get bills first for $180+ and then
$240+ from a collection agent. This is not even a claim of early
termination but more like a fee to terminate month-to-month service.

So is there a class action lawsuit against T Mobile about their early
termination fees? I had switched to T Mobile with the promise that
they provided better coverage for me in my area. Once I signed the
contract and had the phones activated, I learned that I received even
WORSE coverage then before. They assured me that they would get it
fixed, but once the grievance period had passed they "regrettably"
informed me that the problem could not be fixed. I canceled the
contract which incurred a $400 early cancellation fee per phone. This
amounted to $2000 since I had 5 phone lines.

Any help?

Hello All.

I've had the same situation for the past Year! Tmobile lost a warranty
exhcange device in the mail and later charged me 416 for the phone. I
paid it! They later said I never paid it so it went to collections.
Collections has informed the 392 charge is for the termination of my
contract but I AM STILL A TMOBILE CUSTOMER! I AM WRITING THIS FROM MY
TMOBILE BLACKBERRY! I've had horrible service since Nov 2011 and have
yet to receive a credit for anything. My contract has been up for a
year, but my reason for keeping their service is to prove in my court
case that they mistakenly charged me off to collections.

I have a 'I hate tombile page on Facebook' and it garnered a community
of 1,000 + people, a Occupy Tmobile day and still a lawsuit w/ wide
spread media attention is much more effective. If we all exchange
emails, info we could totally put together an online campaign and
lawsuit to hold them responsible.
Imagine if everyone of us created a video of our complaints of Tmobile
on youtube, shared on social networks and created a campaign to get
their attention then later forward w/ our case?

BBB and Ftc takes major time, we have to fight them together.

I'll be back on here in a couple of days to see how everyone feels
about my post.

If this is still going,I want to join the class action law suit
against tmobile as well. My story is kind similuar to the author of
this page and on top of that I found out that I was being charged for
3 line but only had 1 phone and they were aware of this but still
charged me, and this is just a sample of what happend to me. How do we
stop tmobiles extortion?

I am in the middle of going back and fourth with tmobile via the bbb
right now. And for some reason they just dont get it. I have not yet
filed a complaint with the ftc however that is my next step. I am
going to make it my second jobs to launch a war against Tmobile.They
are liars.

Please. please. i want to join a class action suit against Tmobile.
please. please. Where do I sign and what do i do? We too had
horrible service and feel how can we pay for a contract (one we signed
7 years ago) that doesn't hold up to what i pay them for: Phone
Service. They said that to us too; "We do not guarantee service."
Really? Isn't that why I pay you? If I hired a contractor to fix my
leaky sink and he suddenly he says, "I don't guarantee that I'll fix
it." It's crazy. And many people just pay the contact to save their
credit score. We have 800 plus credit and I'm willing to go to court
to stop t mobile as well as change this law. Can someone please

T-mobile collected $500 down on the dec 17-18 2011 special claiming
they were gonna give me a rebate when i signed up for a 2 year
contract and a 5gb data plan. now they wont honer there contract and
there wont be a rebate and the phones are not free as described.
Im stuck with a $2200 yearly bill in addition to a $1200 tab on 2
phones. I called t-mobile and they said that the phones are not fee
and i wont qualify for the rebate after all. Ive been a customer for 8
years and never had this problem, since at&t was going to acquire them
they turned in to bullies and dont care about keeping there word or
honoring there contract.

Yes I want to be in this too. I was a tmobile customer for 3 1/2 years
and i was having problems getting signals, making calls, and dropped
calls. I did two service request where they check to see whats wrong
in your area. Well the techs told me to upgrade my sim cards. we did
that and the service was shitty for 3 months. With in that three
months i did another service request and i called in 5 days later. The
tech told me that they found that they dropped a tower in my area and
thats why i didnt have good service and they is no plans on fixing my
tower. The tech said i was a faithful customer and they breached
contract because of failure to provide service in my area. He said i
can closed my account and not have to pay $200.00 for each four lines.
Now they are saying i have to pay and even when i told them what their
tech said they said we dont have prof that our tech said that to you
and you still have to pay I sent an email to the BBB and tmobile keeps
sending a form letter back and not even reading my issue. when i call
in to tmobile they tell me thats its my problem and i have to pay and
theres nothing they can do about it. Then why tell your customers that
you can end your contract because its our fault and you wont be billed
and then you do. They are big fucking liars.

I would love to be part of a lawsuit against t-mobile! They have out
right lied to me on many occasions and do nothing to keep up their
part of the deal! I have heard many times about what their contract
says! That doesn't change the fact that what they are doing is
illegal! How can signing a sales contract hold a company above the
law?

yes please sign me up. I was told there would be coverage at my house
with 4g service.I purchased 2 smart phones on the family plan $49 each
line. I dropped like a total of $700 opening this account. Right away
i noticed service problems. Niether line was recieving 4g service and
barely a 3g service at that. I was only able to have at the most a 5
minute conversation with out dropping a call and then the calls would
be repetedly dropped like every minute or so. I walked into the
t-mobile store were I had opened my plan and explained to the rep my
problem and told him this is unexcepted. He fed me a line of crap that
when its in 4g mode somtimes it reads 3g and he kept telling me
t-mobile has been doing repair work in my area. well a month gos by
and nothing has changed except when I recieved my bill. There was so
many different charges on the bill $49x2 $29x2 $18x2 and so forth. I
told them this is garbage im cancelling service. T-mobile didnt cancel
my service as requested. I kept recieving phone calls on my existing
verizon acct thank god i kept verizon, asking me to pay my bill to
keep service. I canceled that service atleast a month before that
call. I have been round and round with t-mobile to no avail. t-mobile
expects me to pay like $1300.00. I was lied to on several occasions
and cheated by this corporation. If i had commited the same type of
crime as they have, i would be in jail!

I'm a loyal T-mobile costumer for the past 10 going on 11 years with 5
different lines; I've been trying to cancel one of this lines since
March of 2011, they wanted to charge the 200 dollar cancellation fee
and "nicely" recommended to wait to the contract expiration....long
story short in July the person I open the account for lost his job and
stop making payments service was cancelled for no payment...of course
they sent me to collection department I made some arrangements to make
those payments and ask to freeze the account because I was intended to
closed, I paid over 400 dollars, but .. surprise I receive a bill just
like all this never happened. After so many calls and disappointed
conversation with English and Spanish speaking representatives, one of
them name Olga told me that she will investigate my case to see if she
could help me so I only have to pay 50 dollars cancellation fee...but
I still receiving bills, after 2 moth after one of them told me that
my account was finally closed I receive a bill for 130 dollars, and
weeks later a phone call from their collection department who place a
note on the account that this was an incorrect amount, well on Nov 29
2011 I receive a bill; for 225.47 dollars and on Dic 08 2011 a phone
call telling me that they will sent me to collection if I was unable
to pay this amount... Am I craze or what?
Can some body help me?, what can I do against this delinquents.

I entered into contract with T mobile in jan 2011 with a new phone and
a web connect device to have internet at home. both the new phone and
web device did not work as promised I had no signal strength at my
house,one bar in the front yard, none in the house.I live in downtown
Salt Lake City UT, not up a canyon or out in the sticks. after
numerous complaints to T mobile to fix the problem i decided to go to
verizon with a new phone I have full bars of signal in my house, it
works great. I wrote to T mobile to cancel in sept 2011. they have
continued to charge me monthly fees plus they will not waive the early
term fees. i owed them 100.00 when I cancelled they now claim I owe
them $923.00. I have not used the phone since sept 2011. The only way
they will waive the ETFs is to sign back up and continue to pay for
service Im not getting. You cannot take them to court because of the
arbitration clause which costs 700.00 to file

I signed up with tmobile. Paid 315 dollars to have my phones
overnighted. My phones were intercepted by tmobie. We never saw the
package. When we called to ask why, they couldn't seem to tell us so
we told the we wanted our money back. We were lied to and told we
would see it in 3 days. It has now been almost a month and I still do
not have my money and they also sent us a bill today for the amount of
140 for services we don't even have with them. No one will help us and
when we said we were filing a lawsuit they told us it was our
purogative. Like wow. Going to attorney asap!

I just recently was told my plan which was a flex account was being
discontinued and Tmobile wanted me to sign up for a different plan. I
have only had this account eight months, which has a two year
contract. They expect me to sign up for a new plan which I do not want
with a new two year contract. My service is terrible where I live and
I have complainted serveral times. I told them I do not want a new
plan and they told me I would have to pay a $200 early termination fee
with taxes. If they have discontinued the plan I was on why should I
have to pay for an early termination? They are the ones breaking the
contract. I would love to join this class action suit against tmobile.
I would like to know where they come up with taxes they plan to charge
on an early disconnect fee anyway.

Is anyone still working on this?? I would love to join against them.
I think that Section 3 of the contract which allows them to charge you
for a full month of service even after they turn your phone off. I
was out of contract and decided to leave to At&t. Even after their
agent told me my bill would be pro-rated they continued to send bills.
I was charged for an entire month because under section 3 if you
'port' your number to another carrier they can charge you for the
entire month.
This is hidden and horrible, I'm sure they make millions off of people
like me!!

I have a similar problem in portland, oregon. I terminated my contract
six months prior to termination date because the service was not only
poor where I live but occasionally nonexistent - this was after
tmobile a tech support agent confessed that the reason for the poor
service and the frequent server error messages I had was that I lived
too far from the nearest cell tower and that there was nothing tmoble
could do to resolve the problem. however, I was advised to keep paying
my humongous bill for a service I wasnt receiving. I had to switch to
another company.

I have just received my final billing statement which includes the
$200 early termination fee, even though as a result of a 2009 class
action suit tmobile decided it would assess such fees by prorating
them.

I called and told them of my intention not to pay the fee at all since
the breach was not my fault but tmobile's for failing to provide
effective service as guaranteed under the contract, but it seemed like
I was talking to the wall as the agent I was speaking with kept
insisting tmobile did not breach their part of the deal.

considering the cost of legal fees, which I can not afford at the
moment, I think class action is the way to go.

I would absolutely like to join a class action lawsuit! I moved to an
area with zero coverage and because we had three lines on the account,
it was going to be $600 in early termination fees. I offered to send
all three of our phones back because I realize that the discount you
get on the phones when you start the contract has to be made up for in
some way (although what they charge for the phones isn't even close to
what they paid for it). We even had the same old phones we had had
since the beginning so they wouldn't have been losing a dime on our
behalf. I would even have been ok paying one of the fees if that was
the only way to break away in a clean fashion, but they absolutely
would not budge. I have moved all over the country and have had to get
out of several cell phone contracts for the same reason, and it only
took a little persistence on my part (Sprint, Verizon Wireless, and
AT&T (pre T-Mobile obviously)). Unfortunately, the decision to move
began just after the contract had just renewed (after our initial
first two year contract).

I clearly should not have read some of the replys to this post, since
there's always at least one idiot who responds with some asinine
comment...it's not their fault that I moved?? It's not about
fault...if I have to move to where a job is I wouldn't exactly call
that my fault. In what other instance is a business allowed to charge
for a product that they cannot deliver??

To date I have still not paid the $965 bill (one month of service
charges + "late fees" + $600 early termination fee)that they sent to
collections ("collections" by the way is Pinnacle Financial, which is
also a T-mobile company so the debt is not sold)and I refuse to pay it
now or at any point in the future on pure principle. It's maddening
that enormous companies like that can just do whatever they want
because your average consumer can't do a damn thing about it! Why
aren't there laws in place to protect against such blatant financial
raping? Argh...I get furious just thinking about it.

How is it T-Mobiles fault that you are moving somewhere they don't
have coverage. No carrier has coverage area and is your decision to
make the move.
Plus you have options of using wifi calling. a good amount of their
phones can make and recieve calls over wifi as another option.
Also why should they reward you for loyalty if you are leave? Makes
no sense.
In the long run sucks that you don't get service but would be cheaper
probably to pay the 200 and just get one if another carrier does get
