I want my money!

I purchased an Easy Set pool on July 5th from your Colorado Springs store. When I purchased the pool the associate asked me if I wanted added insurance for $29.99. I asked if your store gaurenteed the product for 30 days. The associate said yes, that if there was a problem with the pool that I could return it to the store within 90 days of purchase so I did not get the insurance. I did not anticipate a problem with the pool but I found out that the pool was to large for my yard. I packed up the pool and brought it back to the store. When I got to the store I told the associate that I had a pool to return. She called someone to help bring it into the store for me. When the manager came to assist me she said that the pool could not be returned. I told her of my conversation with the associate when I bought the pool. She then went somewhere and talked to him because he was working. She came back and said that she would not accept the pool because obviously there was some miscommunication somewhere. The pool was taken off the floor where I was and brought somewhere, probably out back. The manager still refused to give me my money back. She also said that my pool may not be there (in the store) when I got back. I told her that I was going to call the police. She said "good go ahead!" I could not believe a manager would act this way and treat me and my son so badly. I am disabled and going through this experience made me sick and extremely stressed. Now your store has my pool and airpump that I bought and I did not get my money back! I had the pool for only 5 days and it is brand new, never used. Why would your manager take back the pool and airpump and not give me my money? I was furious when I left the store. I went back in and asked who the regional manager was and they told me, but they did not give me his phone number. The manager needs some courses in customer service.

I want my money returned to me for the pool and the airpump that is in the possesion of your Colorado Springs store. I will contact a lawyer if my money is not returned to me ASAP. I have my reciept.

Measure first and you would have zero problems. On the posters in the
store that show the product (where you had to pull a ticket to get the
pool) are the measurements. It also states that the pool cannot be
returned to the store. This policy is also stated in your
informational packet that was in the pool box.
Toys R Us doesn't give out regional managers number, that's why they
have 1 (800) Toys R Us.
My guess is when you were mad you said something like "I don't want
the pool and I'm not taking it".
Call the 1 800 number. My quess is you will get your money back.

A good lesson for you and others: You never accept any store policy
verbally. Just because a check-out person tells you it is so, does not
make it so. You should have insisted on having something in print
stating that the pool could be returned, otherwise it is your word
against theirs.

If I was the store manager I would tell you the same thing "that I
would not be responsible for something you left." It seems when the
manager told you it might not be there when you got back she was
telling you not to leave it. You apparently left the store without
taking your merchandise. IT was still yours. That is a bit
irresponsible on your part.

I have had shoplifters try that game. They leave something you will
not return, and then tell you your staff lost it days later. You owe
me my money now or worse yet come in with saying that left in a hurry
and you lost something they never brought in to start with to the
store.

Being disabled you mentioned! Is it blindness? IF not you should of
been able to measure you back yard and and check the size of the pool.


Your backyard not being large enough is not a pool defect. Sounds like
this COULD of been a Holiday weekend pool party!

If Toys R Us helped you carry the pool into the store, why couldnt you
have insisted they help carry the pool back out to the car when they
refused to honor the return.

I think they should have honored the return since the employee told
you the wrong thing. The emlpoyees should know what the return
policies are.

Did either you or Adam specify what "a problem with the pool" meant?
Did either you or Adam specify whether you could return an opened
package if the problem with the pool had nothing to do with it being
defective? It really sounds as if there was some kind of
miscommunication between you and Adam -- which isn't entirely Adam's
fault.

It also sounds as if you chose to leave your stuff in the store when
you left, and if that's the case, especially because they warned you
they weren't going to store it for you, the fact that it is on their
property doesn't mean they owe you money.

If this isn't what happened -- if you got something in writing from
Adam and Rain refused to honor it or if, after the sales associate had
moved the pool somewhere where it wasn't blocking other customers, you
asked her to have someone bring it back to you and she refused, for
example -- I hope you'll rewrite this letter so that whoever reviews
your request isn't misled into thinking you have a weaker case than
you really do.

Pick up your pool, and donate it to a small local church, or shelter.


You should have done your homework before buying this pool, return
policy, measuring, etc.

Let your mistake be a reward for someone in need.

I think the validity of your complaint lies with the associate who
told you the pool could be returned. If what Lisa below says is true,
then Adam should've known that. I also wonder if this policy is posted
somewhere, particuarly on the receipt.

Also, if they can't take it back, the pool is yours; you should've
gotten it back.

I think your main issue is that from Toy's R Us's viewpoint, there
wasn't anything wrong with the pool. It not fitting in your yard is
not a defect nor a problem with the pool itself. I went to the Toy's
R Us website, and Outdoor items that have been opened are excluded
from their 90 day return policy.

I think your only real option is to pick the items up, since they are
legally yours, and the store manager informed you that they aren't
going to watch them. Maybe you can sell it on Craigslist or Ebay?

First of all, did the manager insist you leave the store without the
pool OR a refund? That is hard to believe. If that happened to me I
would call the police, and I have to ask that since you threatened to,
why didn't you? Doesn't make sense.

It seems more likely that you didn't want to leave the store with the
pool so you left it there. That's why the manager said "It may not be
here when you get back." You left your property in the store.

You opened the pool ("I packed it up and put it back in the box"). I
don't believe they accept opened pools back - at that point you have
bought it and warranty service is done directly with the
manufacturer.

There may have been a miscommunication about circumstances for return,
but I think return of an opened pool is not possible at Toys R Us.
You need to pick it up before someone steals it. They may throw it
out back.
