false advertisement on public television

1st I'm a handicap senior woman, and I would like to lose this waist, and belly fat. That's why I ordered the belt, and cream. I, and many of my neighbors saw ypur advertisement on public television, which entails 300 lbs., 400 lbs., and 500 lbs. will lose the weight using both the belt, and cream. But I received the kit, and I tried to explained to your custom er representative that the belt won't even fit a 200 lb. person. Before I send the kit back to you I'm going to take pictures, and even to try to stretch the belt to prove my case. Because if you don't send me all my money; I will sue your company for all money back, plus shipping, legal fees, court fees, and punitive damages, which will come to thousands of dollars, and if other people goes with me. It will become A Class Action Law Suite, and it willalso become a scam alert.

I want $39.94, plus shipping, and return shipping, too. I talk to customer service last night 7/29, the customer service told me if you keep it then I'll credited you $10.00 back to your credit card, and today another customer service person offered me $15.00 to keep the belt kit. Why not offer me the whole amount back on my credit card, and keep the kit? Maybe the kit doesn't work! You must have received many complaints on the size of belt. If I don't get satisfied I will contact many state Atty. General Offices in many states.
So if you want to stay in business; then you better start treating people much better.

Unless you place it five miles away and run to it every day. Send the
entire thing back and ask for a refund. I don't understand why the
government allows these types of unscrupulous products.

I do not understand why you are threatening to sue the company even
though you have NOT returned the item. In fact customer service has
offered you 2 options. I do not understand why you are NOT satisfied
considering you have been offered 2 options.

Before going any further, perhaps it would be much better to actually
return the product.

To me, this is overkill.

Why would you get a refund AND get to keep the item? Just return the
item. If they don't give your refund THEN you can file a dispute with
your credit card company. But until you actually RETURN the item I
don't see what you are complaining about.

Just because you threaten them doesn't mean you'll actually win the
case.


Only some states let you sue for your fees. And only if you win.


And you as of yet have no proof that you'll win - just your claim.
And you haven't even waited to see if they'll refund you yet.



And remember, just because you threaten a lawsuit doesn't mean you'll
actually win.

Especially since they've already made you offers.

Another preemptive complaint. You are not even giving them a chance
to refund your money. You have to return the item in order to get a
refund, clear and simple. There is no need for a class action suite,
court costs or punitive damages.

I just checked the site: tummytuck.com and it says in good sized
letters:

You choose how to use it. Results vary.

Notice how they don't put in "may" leaving one to assume that it is at
best a shot in the dark on a windless day.

As for one size fitting all they make no mention of that so one would
have to assume that after a certain size one belt will not work. I
have no idea if hooking several together would work either.

Yeah

I do not think that you saw this infomercial on public tv.

I watch public tv, & I have never seen infomercials on their
programming schedule. Public tv receives funds through membership
drives. I doubt that public tv viewers want to donate money for
informercials.

However, I have seen parts of informercials on public access tv.

No, this was not on public television. I watch public TV more than I
watch anything else, and they wouldn't advertise anything other than
their own shows or to get you to join and become a member.

You likely were watching something on one of the public access
channels (which is not the same as NOT "public television"). Just
wanted to help out public TV a bit here.

And what did you think? that you wouldn't have to work out or diet in
order to lose weight?

Before you considered posting this complaint on planetfeedback &
indicating that you will sue the company for all of your money back,
plus shipping fees, legal fees, court fees, & punitive damages, did
you speak to a supervisor?

Because once the company receives your complaint, the only people who
will contact you would be their lawyers.

You do realize that even if you do speak to a lawyer, & if he or she
decides that you do not have a case, you still have to pay him or her
for their services?

It will cost much more than $39.94 to retain a lawyer for your case.
