Employee Stealing from Guests in Framingham, MA store

On Feb 26, my girlfriend and I went to Pizzeria Uno, Chicago Bar & Grille in Framingham, MA. The check came ($31.42) and I provided my Capital One card for payment of the bill, the server took the card and after 10 minutes came back saying that he tried to run my card through 5 times and that it had been declined (should have been my first clue there was a problem, you don't run a card 4 more times after it's declined.) So I provided my bank debit card with MasterCard logo, the card was charged for the meal $31.42 and a tip of $3.58 (the service wasn't too good.) My girlfriend and I went on our way. When my next bank statement came out it showed the transaction as complete with Uno's, however to my dismay when my Capital One card statement came in late March, it also showed a transaction to Uno's on the same date and at the same time for $31.42, and a very generous $18.58 tip for the server (over 50% tip). I immediately called the location who informed me that I would need to call the customer service number for assistance with the matter. I called customer service who in turn told me that I would need to deal with the store manager since they processed the card at the location. This has gone on for over a month, and I'm ready to contact an attorney about this matter. Uno still fails to provide a signed slip to Capital One that I authorized the purchase, and has given Uno 90 days to justify the transaction before they will do a charge back, however in the mean time I am stuck with a charge that I didn't authorize.

I'm not unreasonable, I'd be more than willing to drop going to a legal proceeding if Uno would just refund the transaction on my Capital One card or some such reasonable compensation for their employee stealing from me.

Where I work sometimes the system glitches and a declined card will
run on the second try.



However it sounds like the credit company is already handling this for
you.


As for your "legal proceeding" comment ... remember the following
1) Telling a company that you're getting a lawyer doesn't mean they
have to do what you tell them do. They may even call your bluff on
it. Some companies even stop talking to the customer once "lawyer" is
brought up - they direct the customer to have his/her lawyer talk to
theirs. Which is their legal right.

2) Even if you do decided to pay a lawyer's fees to take a case
against them... only the judge can decide who wins. They may settle
out of court but they don't have to.

3) Assuming the lawyer actually decides to take the case. Some won't
if they don't consider it worth their time. And since your credit
card company is already handling it... they may decide it's not a good
business choice.

wasn't JUST subpar, they were bordering on inept too! Given that the
change on the tip is the same for both, I have to wonder if someone
fat fingered the entry. It's a little too conincendental. But a 50%+
tip is pretty brazen for people that appear to be this dumb, (But I
could be wrong - maybe they really ARE that dumb!)

While I am sure your credit card company will handle this, you will
likely have to wait the 90 days for it to sort out. The whole threat
of litigation seems a bit much, though. The entire charge WITH the
crazy tip is only about $50. Is it really worth the hundreds or
possibly thousands you could drop in legal fees and costs just to take
this to court?

Let them sort it out and then write this place off as a terrible
dining experience. It's just not worth anymore of your time than
that!

So capital one gave uno's 90 days to provide the signed slip. So
there you have it, in 90 days you will get your money back.

What more do you want?

Did you already dispute the charge with Capitol One? If not, do so
NOW. Don't wait for UNO to handle this.
