OVERDRAFT FEES

OVERDRAFT

I have been charged about $400-$500 in overdraft fees over the last month. Without these fees, I could afford to live. Some of them are a consequence of my poor decisions, but half of them are due to their SHADY accounting practices and deceptive violation of the Truth in Lending Act. This is usary. Take for example, the two most recent overdrafts I incurred. My paycheck was direct deposited on 6/5/06 and showed up in my account on 6/6/06. I cautiously used the ATM on the 6th to make sure I did not incur any more fees. I did not know that they would process this transaction PRIOR to a transaction that took place the DAY BEFORE in real time. Minus $50 right there. That would calculate to a ridiculous APR. I have been a customer of Washington Mutual/Home Savings since I was 11 years old in 1989. This is outrageous. I never signed up for this sort of protection. I have had my checking account prior to overdraft protection and debit cards.

I request a partial refund of one-half of the overdraft fees I was charged in the last 45 days. If no mutually acceptable remedy is reached, I will permanantly close my account within a month and make it my mission to villify this bank for their practices.

I'm a bit confused - - are you talking about overdraft fees or the fee
they charge you to process a debit using your overdraft protection?
Also - - your paycheck was direct deposited on 6/5 and appeared as
available on 6/6, at which point you "cautiously" used the ATM but
were assessed a fee due to a transaction that was authorized by you on
6/5? It shouldn't make any difference the order that your
transactions are processed if you have an accurately balanced account
and are not authorizing more to be taken out of your account that you
have available.

I'd say a little more specific details need to be communicated before
Washington Mutual will be able to consider your request.
